Hi, Ive got a claim against them for the MON3727 flight from Sharm to Manchester on the 10/06/12 - pretty sure they will be due to the same issue. I've been fighting it for 2.5yrs & still ongoing
Finally we've won our case - had to employ Bott & Co, but Monarch have agreed to settle this case.

After earlier refusal Monarch have today agreed my Claim for 5 hour delay on this flight. Happy days. :j:Tyesterday is history, tomorrow is a mystery, today is a gift thats why its called the present0

My parents' flight Funchal - Birmingham landed over 4 hours late in April. They have filled in the forms.
Got told in an e-mail that Monarch will not pay out due to 'extraordinary circumstances' due to a part of the inflight computer was replaced. The old part only was installed 9 days prior and only flew 83 hours. They also used the excuse that the part was removed and installed in quicker time than expected.
Plus this wasn't mentioned in the e-mail response, When my parents were on board the plane, the captain said the delay was also down to getting back up air crew as the crew scheduled needed their regulatory time off from flying (or something like that).
Surely its a technical problem and a staffing issue? I don't think you can use the extraordinary circumstances excuse for a below par quality replacement part.
Don't you worry! Dad will pursue this case. We were on a flight from Manchester to Palma in June 14 that had to make an emergency landing at Gatwick. We were due to land at about 8 pm in the evening but finally got there the following afternoon, effectively losing a day of our holiday.
We put the claim in the Monarch which they refused and so we started the court claim (using the fantastic guide). Monarch have defended the claim using hidden manufacturing defect.
Liverpool Court asked them to provide a list of all other claims against this flight but we have never been copied into their reply, nor do we know if they actually replied. Subsequently, Liverpool court has ordered the case be transferred to Luton as Monarch were defending the case using something other than Huzar.
I have subsequently found out Flight Delays have actually won a case for this very flight - it is on their website.
We are still waiting for a date from Luton Court so I have only put together a background case but what are the thoughts for moving this forward?
Do I contact Liverpool Court and/or Luton Court and ask them for the list of other cases?
Do I have another go at contacting Monarch to see if they will now pay out (with additional costs incurred so far, obviously)?
Is there a way of finding out the court case number for the victory by Flight Delays other than asking them direct (presuming they will obviously wish to take up the case themselves)?
Any other thoughts?

Firstly which court did you select the case to be heard in (presume your local court), what year was your delay and what was your flight number?

We asked for Sheffield, our local court, but Liverpool allocated to Luton as they Monarch claimed they were having two expert witnesses that needed to be in Luton.
As stated above it was in June 14 and flight number was ZB534.0 -
As an LiP you have a right to have case heard in court that convenient for you, not the large company defending, irrespective of their "expert" witnesses. Have you received copies of the witness statements and all of Monarch's submissions?
Contact Monarch and suggest immediate settlement, copies of all submissions, specfically what defence they are relyiing on.

Realising from your original post the delay was in June I requested the year so I could do a check for you however JP has provided an advanced, correct, comment. As he says you are the LiP so if Monarch want to use expert witnesses that is their problem and should not be yours. Request Monarch and their entourage attend Sheffield and stop their bully boy tactics to try and discourage you from pursuing your legitimate and valid claim further.0

Thanks JP. We have just received the defence statement from Monarch, nothing from the witnesses. The last correspondence we received was from the court in Liverpool about a month ago transferring the case to Luton. How do we get it transferred to Sheffield? We have not received any date for a hearing.
When contacting Monarch is it worth mentioning the case that they have lost for the same flight?0
