Just to let people know that I sent in my claim on 12th May 2015 for flight MON1288 Manchester to KOS on 04/08/2010. As it was 5 years ago and at the time Monarch refused on the grounds of exceptional circumstances, I had all but given up on it. I was even less convinced by the fact that I had not seen this flight mentioned anywhere online at all. When I did not get a reply after 28 days (36 total) I rang them back and was told by someone called Rebecca at Luton Airport that she would email me same day to update me. The email never arrived and so next day I rang was was informed that we would be receiving 400 euros each or 2000 euros approx £1400 total for a 12 hour delay. I am delighted and just want to encourage anyone who may have been on this flight to go for it.0

Yes - plane no longer in fleet. Their entire defence is just technical background regarding parts and maintenance data which is not relevant
Besides that the fact that Monarch only seem to suggest a HMD effected your flight is when the plane in question has left their fleet together with its log book and all flight/repair records.0 -
up to £90 can be received in respect of time of work
No payment in respect of copying, postage or court preparation.
The allowance for time off work has increased to £95 I believe, see 7.3 (1):

You can ask for just about any costs amount (and time at an hourly rate for preparation etc.) under section 27.14(g):

However, you will need to show the other side acted unreasonably and convince the Judge to award the costs to you (something that happens very very rarely). Defending a claim (however hopeless the defence) is also not usually considered as unreasonable behaviour.The above is just my opinon - which counts for nowt! You must make up your own mind.0 -
Monarch flight ZB581 Faro to Manchester 3 November 2012.
I have been writing to Monarch since 2012 trying to claim compensation for our family on the above flight and have been fobbed off and ignored repeatedly. After the latest stated cases I tried again, but was just ignored by Monarch. I had neither the time nor energy to go to court, so contacted Bott & Co on the 27th May this year. Within 2 weeks Monarch had agreed to settle and within 1 month the money is in my account (less solicitor’s take).
I think it is an absolute disgrace that you have to hire a solicitor or go to court before a UK based company will pay compensation required by law. It is high time an ombudsman with binding arbitration powers was appointed to stop this nonsense and protect consumers, so they can receive the compensation they are rightly due.
To anyone who is considering giving up… don’t! Go the no-win no-fee route if you can’t face taking them to court yourself. 66% is better than nothing and airlines will only be forced to take measures to reduce delays when it becomes economically advantageous to do so.0 -
Oh come on Lancs. Get real. Of course it's a disgrace but the only way to stop them is not to let them mess you about. You did the right thing by showing them that you weren't bluffing. If everyone did this, they would soon get the message0

I was delayed in 2012 - sent an NBA after 14 days - then went MCOL - another 28 days elapsed and Monarch defence (for what it was worth) received - after two hearings 'won' case and all in all took around 5 months. Don't know why you waited over 2 years Lancs as IMO better to get these things sorted sooner rather than later and playing letter ping pong only plays into their hands.0

I was delayed in April 2012. Wrote to Monarch in May and again in October (following Sturgeon). Having got no reasonable response I started legal proceedings in January 2013. After three court hearings (yes really) I got paid in full, with interest and some costs, in February 2014. Following the Huzar judgement, it is not infinitely easier. So my advice to all is that, if the airline messes you about, start legal action without delay. The airlines rarely have a proper defence, and it's the only way to make them pay up if they've decided to mess you about.

I have just received £283.04 in compensation for Flight Details: ZB253 27/10/2012 ALC-LGW.
This was previously denied by Monarch, but I just resent all my details and told them I believe due to changes in policy I am now entitled, and low and behold I now have the money in my bank! Great!0 -
had a twenty four hour delay way back in october of 2010, sharm to gatwick,i am in the throws of taking monarch to small claims, they did answer one of my letters, stating the flight was delayed 20 minutes, Yes this was the flight we eventually took, some 24 hours later even that was slightly late,anyway they state that no more correspondence will be entered into, and i was therefore left in the dark regarding flight zb5115,ive tried to find this flight on this thread but cannot see, just need a bit more ammunition for the courts, anyone out there that can help, regards0
