  • So - went to Court today and won.

    Not the most straightforward case and the judge hadn't seen any of the bundles (which we'd had to submit in June!) it was regarding hidden manufacturing defects. Key points were that the problem was a known ongoing fault with the aircraft, and this was an integral part of operating an airline. The ability to replace the throttle was entirely within Monarch's control.

    Therefore, not an extraordinary circumstance.

    Didn't award any interest on claim, but Monarch agreed to pay in Sterling using exchange rate at date of delay.

    Monarch asked for leave to appeal - this was denied as EC's are a question of fact.

    Have to say, turns out that there was someone else on same flight also claiming (completely independently) and they had a barrister representing them, which I was very grateful for.

    Also - I managed to add 2 parties to my claim on the day even though I'd not used the correct form when starting proceedings - just needed written consent.

    Well done bud,:T I am due in Luton in a few months, going from Manchester! shame you did not get interest perhaps it was because how long ago the delay was. Did you get your costs back?

  • Batman - got costs of
    Court hearing £340
    Parking £6
    Travel (250 miles at 45p per mile) - had to drive from Bristol to Luton
    Day off work £90 (max available in small claims court)

    Did try claiming other costs on basis Monarch had been unreasonable (missed every deadline set by Court) but that wasn't upheld.

    Best of luck, all I can say is make sure you have a spare bundle and give it to the clerk when you arrive just in case the judge hasn't been given it in advance
  • Bott & Co successfully got me compensation for delayed Monarch flight ZB834 from Luton to Corfu on 1 September 2014. Despite the fact the CAA said I was entitled to compensation Monarch still refused to pay up which is why I went to Bott & Co as I didn't fancy going to court myself. Excellent and fast service. They charged me 27% plus EUR25.
    Sadly they won't handle my claim for my return flight from Corfu to Luton ZB835 on 8 September 2014 which was cancelled. Monarch did however refund my costs i.e. food/drink, train from Gatwick to Luton, extra days car park.

    it say's on their site that flight is eligible for 400euro per passenger. Strange
