  • My claim of November 2012 has finally been replied to.

    MON5278 01 August 2010 Gatwick to Sharm El Sheikh
    Denied on EC's -

    "Our records show that the aircraft scheduled to operate your flight suffered a gearbox fluid leak, rendering the aircraft unserviceable and unsafe to fly. Despite our best efforts we were unable to transfer passengers on your flight to an alternative aircraft within our fleet. As a consequence, the flight departed as soon as the aircraft became serviceable."

    Think i'm going to get a legal firm to assist my claim

    After escalating my claim through Resolver i was successful in my claim without needing to go to court for my wife and I.

    Cheque's received

    Resolver seems to do the trick so recommend it to anyone having no response from Monarch

    Funnily enough, yesterday i received the another cheque so have received the full amount claimed for.
  • We are about to go to Court. Monarch are claiming extraordinary circumstances based on ongoing issues with Airbus throttle cable jamming. They have submitted a number of service bulletins showing this was a problem and evidence of an A300/310 Symposium which Airbus held in Istanbul 18-20 October 2011. One question is whether other airlines who also use Airbus have been making the same extraordinary circumstances defence? Also, as it has clearly been an ongoing issue for a number of years can it honestly be described as a 'hidden' manufacturing defect?
    Can anyone shed some light on this?
  • I am going to Court on the same issue in 3 weeks' time. Please can you post the details so that I can quote them when I go to court? Which court was it heard in ? What date? What surname? And who was the judge? Reading your post I feel so much better as I have been so anxious about this, especially as Monarch sent a tree's worth of supporting paperwork for their claim.

  • I would get them to produce all correspondence with Airbus and all other relevant documents to include all previous occurrences that they are aware of and whether they have made claims for compensation.

    just sent you a rather long PM - this is the point that I won against Monarch 3 weeks ago.

    Am surprised (or on balance, maybe not) that they are going to try exactly the same argument that they just lost with.

    Whilst county court doesn't set precedent for future decisions, it does have merit for consideration.

    Monarch playing games again. Sounds like one of the Monarch A300 planes which rather conveniently (for your situation) they no longer have - http://www.monarch.co.uk/news/flights/2014-news/monarch-airlines-last-commercial-flight-on-airbus-a300-605r-after-23-years-of-service - so as with their former Boeing planes they claim hidden manufacturing defect. Slightly difficult for you to ultimately prove (or indeed Monarch) if the plane is now a Coke can however do not despair previous replies and my own PM will show you the way to go ... via court if necessary ... but I doubt the need.
