Anyone had success with making a claim for delayed flight ZB228 (MON 8486 stand in aircraft) 26th July 2013 from Gatwick to Palma (Majorca) delayed approx. 9 hrs.

On Monday, Monarch reassigned our plane to Tenerife rather than Corfu on the morning of travel. They split the flight into two smaller planes but got the wrong side of the coin and was put on a flight to Corfu 9 hours later (but this was delayed a further hour!). No technical problems just a logistic !!!!-up according to the pilot who eventually flew us there.

I'm assuming Monarch had a choice; honour the planned flight to Corfu as submitted or not.

Yes. You have been denied boarding, which is much more difficult for the airline to weedle out of using EC. Get your claim off.
Come back when they refuse to fin d out how to go to court.

Any body had success in claiming for a 4hour + delay? My claim was rejected due to EC!

If Monarch go bust, into administration and/or sell out based on info. on the Pilots forum above... will all bets be off for flight delay compensation from them or the new owners?

If we attend County Court on 22nd Sept. and win will they have to pay up before they do go under?

They are trying to get us to agree a further stay - due to pending clarification of Huzar vs Jet2 by EU?? courts - and have written to court asking for a stay.... our costs are mounting as this will be second visit to small claims court on this matter...plus admin costs - should we take another day off work and risk it being stayed again?

Any thoughts would be much appreciated...

There is no prospect of Monarch going under this year. They are looking for outside investors which is a first, the airline and the holiday group have been backed by a secretive Swiss family for years who have decided they would like to stay rich rather than put more money in. They have a reasoned plan to change operations from April next year, no more charters, no more long haul flights and their new MD left the BA group where he had been for years to join Monarch, not a sign they are going bust any time soon
