Monarch delays & Compensations. Listed flights denied in O.P.

Just banked a cheque from Monarch for 3x€400 + £235 court fees + 8% interest from flight date. Judgement granted by my local CC on Monarch no-show - such a pity as it would have been fun to demolish them. They then ignored the judgement until I threaten to instruct my solicitor to apply for a Warrant of Control in the High Court at their expense.
They demand I return a receipt, plus file a N279 Discontinuance form on the CC (for which I’d incur a further court fee) + their para-legal pinheads also have the gall to claim “Please note that the settlement amount and terms of settlement are strictly confidential between the parties”. To all of which - yeah, right!
Anybody on these flights should be claiming on Monarch (some already have) - ZB246 may be stayed by Huzar v Jet2 appeal, but no EC defence applies to the other 4 flights:
1. ZB246 LGW/SSH 13Oct2012 delayed 4+ hours by defect, claimed as EC by Monarch.
2. ZB247 SSH/LGW 13Oct2012 therefore delayed to 14Oct2012 as crew exceed legal flying hours (knock-on & predictable when ZB246 departed).
3. ZB248 LGW/SSH 14Oct2012 therefore had no plane/crew to service it, so Monarch co-opted the plane/crew intended for ZB742 below (an entirely operational decision).
4. ZB742 LGW/AGP 14Oct2012 therefore delayed by 4+ hours (waiting for a substitute plane/crew).
5. ZB743 AGP/LGW 14Oct2012 therefore delayed in turn to 15Oct2012.
My thanks to Mark2Spark, Vauban, 111KAB & many others whose posts informed & sustained me over the 20 months.
Persist, persist, persist - don’t let the !!!!!!!s grind you down.0 -
Great to hear wytangel - well done!
Monarch are a joke: after they were thrashed in court and ordered to pay over three grand in my case, they sent me a similar notice of discontinuance and confidentiality agreement. I ignored both.0 -

Just arrived back from Menorca. Outward flight ZB038 on 13/8/14 from Luton arrived at 14:10 local time - scheduled arrival was 10:40. A technical fault was blamed - the captain later explained it took a little longer to fit the part than expected! I have completed an initial compensation claim letter and mailed it to their post flight customer service centre and will keep the forum posted on developments.0

Hi,
I don't suppose anyone has had any luck with ZB248 (LGW to SSH) on 21/07/2013? Flight was 5 hrs delayed - unknown reason.
Also, is there any precedent on large group bookings made by the Monarch Group Booking service? Is it worth submitting paperwork for one person in the group that was on the flight and then following up later if successful? Or just launch in with all of them?
Thanks0 -

In the order you have asked...
1) You may be better looking at https://www.facebook.com/MonarchComplaints to find other delayed passengers.
2) Monarch will quote 'extraordinary circumstances' caused your delay - standard wording.
3) Single or multiple bookings make no difference to Monarch - they have a blanket denial of all claims - following the extraordinary circumstances denial you will receive notification that all claims are being frozen (stayed) as a result of the Huzar appeal.
4) Claim papers submitted to Monarch cost nothing so you may as well obtain all the information they require now and, only sending copies, lodge your claim now.
5) There is no way they will pay out so once you receive their EC and Huzar excuses for you then to decide if you are going to front court claim or use a NWNF.
6) Do not use the potential of a payment to book your 2015 holiday although 2016 may be a possibility.0 -
Hi
Our flight from Palma to London gatwick was delayed by 22hrs due to an engine fault.
When we arrived at Gatwick an agent of monarch gave us a claim form and told us we were definitely eligible to make a claim. I duly submitted this,
I then received an email today saying they were putting my claim on hold whilst they await some decision by the Supreme Court over technical faults. Is there anything I can do or do I just need to sit and wait?0 -

Just to let you know if you ring them directly and ask for the EU claims department or non EU claims department I presume for non EU flights you should get it sorted quicker.
I posted them a letter in June 2014 after getting back from holiday about our June flight in 2012 (we had been turned down for compensation back in June 2012. I had decided to try again) as I had read we could claim.
I received nothing. On ringing them I was told that it would have gone to customer services as I hadn't directed it to EU claims. I also hadn't sent it in with the claims forms.
They are very helpful in the EU claims department. They hadn't received my letter as they said it wouldn't have gone to them.
The lady gave me her details to send it directly to her. She also emailed me the claims form. I sent the claims forms back in last Wednesday along with a covering letter.
I rang them this morning. I spoke to another nice lady who said the letter had been separated from the forms. I sent her a copy of the letter via email whilst I was on the phone. She dealt with it there and then.
I got a response about an hour later. We have been awarded compensation x 2 for the delayed flights of £316 approx plus £75 in Monarch vouchers to be used by next year.
As we fly regularly with Monarch because 1 of our holidays per year is with them as we go to the same place once a year, that may have been why it was dealt with so quickly, I don't know.
However I just wanted to tell you our story and let you know we have had a positive outcome.
The cheques for the compensation will be received in the next 21 days.
I thought this maybe of help to those struggling with Monarch, on additional information to help your claim0 -
Flight ZB535 from Palma Majorca to Manchester on the 7th. June 2014 - delayed four and a half hours - 6 in our family party including 2 children (3 and 2 years of age)
Made claim to Monarch who say they are parking all complaints about such flight delays pending the Jet2 appeal concerning aircraft technical faults etc. and will not respond until October 2014 at the earliest.
We cannot report to CAA as the flight was not from the UK (even though it was going to the UK) so who do we report to?
What is best way to pursue our claim and make sure they pay up?0
