Imandeville _ I provided you with a suggested link via a PM and it would appear you have not received this. Monarch are leading you a merry dance and the only way of getting off the dance floor is to take them to court. I have followed this forum for some time having suffered a delay to flight ZB742 Gatwick to Malaga on 28th May 2011, the delay was 8 hrs 25 minutes. The initial response from Monarch was the normal " exceptional circumstances" .as I did not feel confident to pursue the claim through the courts I contacted a NFNW company on the 19th March who took up the case.
They informed me on the 7th April that Monarch had not replied to their initial correspondence within 14 days and that they were sending a chaser that day.
To my surprise they e-mailed me on the 8th April to inform me that Monarch had agreed to settle!
I will let you know when the monies hit my bank account.
I have to say that I would not have pursued if it was not for the information that I have obtained from this forum....thank you!0 -

I went back to Monarch asking them to reopen the case based on the legal information that I have gathered from this forum and elsewhere. This is their response:
[FONT="]For your reference the fault which occurred was not caused by a failure to maintain the aircraft. The component which failed is considered ‘on condition’ which refers to parts which should not require unscheduled maintenance or replacement during normal operational service. When parts such as this fail during normal operation when maintained in accordance with the relevant maintenance programme this is an unpredictable event. [/FONT]
[FONT="]In direct reference to the recently released EC guidelines regarding extraordinary circumstances you will note that failure of on-condition monitored parts when they have been correctly maintained in addition to any technical defect which becomes apparent immediately prior to departure or in-flight which require investigation and/or repair before the aircraft is airworthy for the intended flight are considered an extraordinary circumstance.[/FONT]
[FONT="]Following this review we are satisfied that our [/FONT][FONT="]initial assessment of your claim was correct and delay compensation will not be paid.[/FONT]

More seriously, did you read David's useful thoughts that he posted in reply to your first post? On the back of that, you can make a decision about whether you think you have a case. If the NEB guidelines are giving you pause for thought, do a bit more reading -or appoint a NWNF solicitor. (If you take this to court yourself, you need to read many of the other posts, and get across the law - which is not impossible, but does require some effort.)0 -
Just received 800 euros compensation for 2 passengers on Monarch flight ZB627 from Lanzarote to Manchester on 12/02/13. Monarch initially denied and denied, but did a U-turn after being contacted on my behalf by Spain's AESA0

Hi there iam new to the forum, and was looking for advice, a few months ago I seen Martin Lewis on TV regarding flight compensation, and we were delayed on a monarch flight back in June 2012, ZB684 leaving from Manchester to sharm el sheikh we where delayed for 6hrs 36 mins before we eventually set off, I when on the Mse website down loaded template filled in everything needed and sent copies of my booking form from the flight, I gave them 14 days to reply but heard nothing so I sent a followed up letter after the 14days and gave them 28 days to reply and still nothing it's been nearly 8 weeks since I sent the second letter, so I have now filled in the CAA online form and wait to have response from them, just wondered am I in the right tracks or has anyone else been denied compensation from this flight. ::(0

Unfortunately not as really you should not have involved the CAA - read various posts and in particular refer to FAQ's on Page one.
