    Your right, but i dont have the confidence to take it on myself, especially given now the CAA have sided with the Airline citing those guidelines

    I understand. Though I think there must be a very good chance that, even if some elements of the Huzar judgement are not upheld, the CAA's random and illegal checklist of nonsense will not survive judicial interrogation.

    Indeed, I wonder if anyone who has lost their case on the basis of the guidance posted by the CAA will be able to hold them liable for their losses, if said guidance is discredited by the Court of Appeal?

    That is a very interesting scenario. If the judgement refers to the judge being swayed by those guidelines, then I think there is every possibility of another judge finding against the CAA in any proceedings commenced against them.

    Happy to say have been paid out.
    Thanks to Bott & Co got £226 each. They take a large cut but I would not have anything as I would have never got round to taking it to small claims. :)
  • ZB217 Faro - Gatwick 20/08/12 Previous flight emergency floor lights Knock on EC (526) is listed on your flights denied for ECs. Is that a final ruling? My friend submitted her claim form, followed up with a copy and email and has had no response from Monarch. As she works on a Sunday and had to get back, she bought another ticket with another airline as the delay lengthened. What would you advise in the circumstances?

  • Good news about #1412 - my wife's company took this on as a trial case. They issued an LBA and we've now got an offer letter from Monarch for a full payment of around £1900 for 6 people.

    I would appreciate any thoughts you have on this.

    I am taking Monarch to the small claims court for a 7hr delay from sharm el sheikh to gatwick due to a throttle jam.

    Whilst awaiting a court date, I have just received notice that the action is stayed because monarch are "seeking a stay pending determination of applications for permission to appeal before the Court of Appeal".

    I understand that means my case is on hold for the mo, but I don't understand what is happening with respect to the CoA.

    Any translations greatly appreciated!

    hi all, had an email from bott and co on thursday 3rd april to say monarch had now paid them for our claim so expecting payment from them in next few days

    Hi All,
    I am now in the depths of my case and could do with some advice from those with experience.
    There are specific questions I need to ask that can only be be answered by Monarch i.e

    1. I want a 24 hour log for the plane so we can see exactly what went down.
    2. I want to know exactly what was done to evaluate alternatives to us sitting on our @ss@s waiting for those kindly folks at Monarch HQ to come and rescue us.

    I have studied the Defence and have what I consider a good legal argument to answer all 20 odd points made. Do I prepare a detailed refutation and hope for the judgement without a hearing? (Monarch have asked for a Huzar stay) or do I act daft and keep my powder dry and save my good stuff for the hearing?

    I am quite looking forward to the battle and think I have a strong case. i don't want to be too specific in case this site is monitored. I think the element of surprise is all I have against trained lawyers.

    Manosteel - do not get too technically orientated (unless you are an aeronautical engineer) and just stick to the fact that you were delayed greater than 3 hours due to an ordinary circumstance (ie a plane going tech).
