    Hi all, just a quick update ref MON1874, got home from work to an e mail from my NWNF company, our papers have been issued to court today I'm quite surprised as I wasn't expecting anything at all to happen before the Huzar case is heard, small slow steps !!

  • HI. i flew on Monarch ZB264 Gatwick To Alicante on 13 July 2012. Does anyone know if compensation is being paid for this delay (over 5 hours). technical problem. Monarch have said NO, unsurprisingly. thanks

    You can search the thread for that flight and see but one passenger being paid doesn't mean others automatically are. You need to read the FAQs and decide whether you have a good case and then, if so, whether to take it yourself or engage a no win no fee firm.

    MON 5329 After a 16 hour delay on this flight in September 2012 we went through the familiar process of stonewalling and refusal of responsibility. The CAA have found in our favour but Monarch have still stood their ground so I have sued including the three members of our party.
    Monarch have until 5th of April to mount their defence so I am expecting the bundle imminently. I admit to some trepidation despite the strength of our case.
    If anyone has any pithy advice I would love to hear it. I have a feeling that I shouldn't pretend to be a lawyer but should present a good lay-man's case appealing to common sense and natural justice. I hope I am not being too naive.
    I intend to make my reply as simple and short as possible and save any big guns for the hearing. What say you?

    You are taking the right approach but do not be too 'laid back' as you will need to be aware of the various cases (261/2004 and Huzar in particular assuming Monarch have used their standard extraordinary circumstances nonsense) however it may well be they seek a stay based upon the Huzar appeal.


    Really there is not a lot you can do until you see their defence but a number of us have been there before you and should the case ultimately proceed to a court hearing there are aspects such as their Event Printout and a Skeleton statement (often a good place for the 'big guns') which should be addressed.

    The case is currently listed to take place on 23 May 2014; however the judgment may not be delivered for anything up two months after that date.

    Your right, but i dont have the confidence to take it on myself, especially given now the CAA have sided with the Airline citing those guidelines
