On reading Vauban's experience I wanted to check to see if the reason for the delay (below) to my flight was due to a 'Extraordinary circumstance' or if I had a case before pursuing. Please note that this flight is listed on page 1 under Court success.
"As previously advised, in some circumstances passengers may be entitled to compensation for delay arising from such disruption under European Union laws. However, any monetary payments are subject to certain criteria being satisfied. Under these laws where the disruption is caused by an ‘extraordinary circumstance’ which the airline was reasonably unable to prevent, the carrier is not obliged to pay compensation. Extraordinary circumstances have been defined by the courts and the European Regulations themselves provide a non-exhaustive list of which circumstances can indeed be categorised as extraordinary.
Our records show that the cause of your delay was due to the unforeseen sickness of a First Officer who fell ill less than six hours before he was due to report for duty to operate the outbound flight from London Gatwick. In the circumstances we made every effort to allocate other flight deck crew members to the flight, and the first officer who operated your flight reported for duty at 11.30am in order for the outbound flight to depart. However, due to the late departure of the outbound flight unfortunately this led to a delay in the scheduled departure time of your flight.
It was also unfortunate that in spite of exploring all conceivable options, there was no availability within our own fleet to transfer your flight to another Monarch aircraft or indeed to transfer passengers to an aircraft chartered from a third party operator. As a consequence, the flight departed at the earliest opportunity with the first available First Officer.
Having considered the factual background of this case, we are satisfied that the disruption was caused by an extraordinary circumstance that could not have reasonably been prevented by Monarch Airlines. We are, therefore, unable to accept your claim for compensation for the reasons given."0 -

Well in that case you have a legitimate claim as yes you may experience some delay whilst the source a new 1st officer but for a mainstream airline who boast they are one of the largest airlines in the UK (with a Gatwick hub) this is ridiculous.0 -

I appreciate your time in replying.
In two minds with to go for NBA/MCOL route or give it to someone like Bott&Co.
According to flightstats my flight was cancelled although i'm sure we got the same one home later in the day.

Hi
I have just received an email from Monarch telling me I'm not entitled to any compensation when my flight was delayed 6 hours from Manchester to Sharm-el-Sheik on the 29/06/2013. They have said that because they have said they couldn't have prevented the delay!!
Has anyone else received compensation for this flight or any suggestions on what I should do next??
Any help would be appreciated

Hi Everybody
After reading this thread I decided to send Monarch a letter ten days ago with regards to flight MON302 Sanford to Manchester on 17.6.2011. Last Saturday I received a form to complete, which I did and sent them back to them on Monday this week.
Yesterday I had an email from them saying they would be sending £493.45 compensation per person within the next 21 days.
I cannot believe how easy it was and how fast they have processed the form.
So anybody who is thinking about doing this just send the letter.
Thanks for all the help in all the posts as I really would not of done this if I had not read this thread.

CONGRATULATIONS..... I too have just received a pay out for this flight.
I was going to go down the MCOL route as Monarch had denied my claims/letters (contacted several times since July 11) but having been blessed with two grandchildren my time is precious.
I wrote to the CAA and it took 11 months for a reply (which is after I initiated Bott) and the CAA said they had written to Monarch to say they agreed that Monarch SHOULD pay out.
I went down the BOTT & CO route and have to say I was extremely impressed by the quickness (initiated end of Oct 13) the claim was settled and by how Bott kept me informed all the way.
I know that others have been paid out for this flight so if you were on this flight CLAIM0
