    Hi :) I'm expecting them to fob me off too. Did your friends pursue the claim? I'm expecting to have to go via the court route. We know it doesn't seem to make any sense at all to pay some passengers but not others. I suppose they have to try and save where they can though - plenty will give up and leave it at that. I expect the next reply will be that the fault was with the plane from Manchester, which led to a knock on delay etc.

    They still cannot believe they will have to go to court (as they live local it would be the same court as I went to) and despite my writing to Monarch EU team on their behalf (zero response) it looks like this is the only option open to them. As with me it is/was not a question of money rather a 26 hour delay however I was boiling over whereas they were/are just hot!

    Ouch! That is an awfully long time to be kept waiting I would probably have been boiling over too. Our delay was only approx 5 hours, but still with a 3 year old wasn't ideal.

    I dare say I might have been happy with just the cost of the flights as compensation, but with Monarch and their selective attitude, I feel obliged to claim for the correct amounts. Paying one or a group of passengers on a flight but not others makes no sense at all. I suppose the part in my favour if/when it goes to court will be to produce evidence of others on the flight being compensated.

    This just proves, once again, that the airlines have no intention of playing by the EU rules. When it comes down to a court case they will, in many cases, give in at the 11th hour because they know the law is not on their side.

    Regardless of EU rules, honesty, morality, integrity they will continue to fight a genuine claim.

    Why? because they can.

    Why can they? because the CAA allows them to!

    I have checked our systems and I can confirm that no passengers have been paid for flight ZB532 under the EU261/2004 regulation.

  • Hi, wondering if anybody has any thoughts with regards to my recent delayed flight. The flight was delayed as a result of the incoming Manchester to Palma being delayed.

    Monarch are telling me that the flight landed 2 hours and 58 minutes late, landing at 16.23 (UK time) instead of 13.25 (UK time).

    The time it should have landed was based on an original departure time of 11.50 (Spanish time), however we were notified beforehand and asked to accept a change in the original departure time from 11.50 to 11.35, HOWEVER it never looks like Monarch though bringing the departure time forward never brought forward the arrival time in Manchester???

    My simplistic thoughts are if you change one time and bring it forward surely the arrival time should be amended as well.

    I have pointed this technicality out to Monarch who have gone very quiet at their end.

    Thoughts and opinions as to where I go from here would be appreciated.

    If I try and claim I have got to go via Spain as the CAA won't look at it as it is an incoming flight, but wonder if the CAA can help on the grounds of misinformation in the first instance.

    I've had a quick look on FlightStats and its showing as 178mins delayed. I think this is 2 minutes shy of the minimum amount allowed before you can claim. Someone better placed to advise might be along soon to add more.

    I think they have to give you a certain amount of notice of flight schedule changes - how much notice did they give?

    Yes flight stats does show the 178 minutes delay BUT with a departure time of 11.50 - there is nothing showing the earliest departure time WE HAD TO AGREE TO!!

    Seems to me like Monarch have got you here .... if I read this correctly you agree to an earlier departure time but Monarch did not advise of the likely knock-on arrival time and basically the scheduled arrival time (un-revised) was missed by some 2 minutes short of the three hour threshold.


    Whilst the Spanish NEB may agree with you their comment stands for nought as Monarch will turn a blind-eye and there is no judicial standing behind a NEB/CAA comment. You may as well forget the CAA, their ex-chairman is now a director of the Monarch.


    If I have interpreted your post correctly I believe Monarch are at fault however getting them to admit any responsibility ...... well forget it!
