    Unsure from your post if you have already submitted to their EU department - if not you should do so and wait the 28 days to give Monarch the opportunity to pay your legitimate claim. After 28 days it is in order to submit either your 14 day NBA letter or appoint a no win no fee.

    Yes i submitted all of the claim forms and had the "no" reply letter back from monarch but this was a few months ago and frustratingly now cant find the letter, grrrrrrrrrr :mad: so due to life just being hectic i havent done anything further, but due to receiving the email from them last night which is very strange as they replied months ago, its fired me back up to do something, if i win its a £2500 claim so worth the fight i think :beer:
  • hi all this is the letter i have received from monarch ........ can anyone advice me if its worth taking it further ? is this exceptional circumstances ? and is CAA my next port of call ?

    Further to your claim for delay compensation, we are writing to advise the outcome of our investigation into your case.

    Monarch Airlines aims as its first priority to provide its passengers with a safe and efficient service. We would like to reassure you that every reasonable effort is made to ensure that our flights depart on time and in the unlikely event we are unable to do so through disruption, we aim to provide a solution at the earliest opportunity.

    As previously advised, in some circumstances passengers may be entitled to compensation for delay arising from such disruption under European Union laws. However, any monetary payments are subject to certain criteria being satisfied. Under these laws where the disruption is caused by an ‘extraordinary circumstance’ which the airline was reasonably unable to prevent, the carrier is not obliged to pay compensation. Extraordinary circumstances have been defined by the courts and the European Regulations themselves provide a non-exhaustive list of which circumstances can indeed be categorised as extraordinary.
    Our record show that the aircraft originally scheduled to operate your flight suffered incurred a pre-cooler fault and for safety reasons the aircraft was declared unserviceable until the problem could be rectified. In order to reduce the length of your delay and minimise the disruption to passengers, passengers on your flight were transferred to the first available aircraft from within our fleet. Unfortunately these events led to a delay of the scheduled departure time of your flight.

    Having considered the factual background of this case, we are satisfied that the disruption was caused by an extraordinary circumstance that could not have reasonably been prevented by Monarch Airlines. We are, therefore, unable to accept your claim for compensation for the reasons given.

    Perhaps start again with a claim form etc to their EU Claims department (keep a file/copies this time!) as even if you go no win no fee (due to life being hectic) following a 'no' from Monarch again you should end up with c. £1,800 and even more if you pursue yourself.

    The standard/ordinary/boring response from Monarch. Suggest you read through this thread (start on Page one) and decide if you want to front a claim yourself or use a no win no fee firm.
  • ok maybe i am not up for the challenge myself, so can anyone advise on a no win no fee company ???
  • hi everyone,ni was just wondering if it would be worth trying to get compensation from monarch in 2007,14 hour delay for a wedding party of 18?it was from Manchester to crete,they did move us all to a hotel,ive looked everywhere for the paperwork but it was so long ago I must of bined it.thanks in advance.

    Unfortunately over 6 years ago so 'out of time' - pity as that would have been a substantial amount given there was 18 of you.
