Hi all, Just been reading through all the advice and I've finally got round to going down the claims route (MCOL). The flight is ZB248 Gatwick to Sharm on the 23/06/13. It was due to a pre flight crew sickness and I received the same response as everyone else. Think I've got a reasonable case as they should have cover for sickness. I'll try and keep you informed!0

ZB532 Manchester - Palma 09/04/11 Rudder defect
I eventully decided to instruct Bott and Co and just had an email to confirm Monarch have agreed to settle the above claim - please note it's one of the flights on page 1
My flight was ZB533, the return flight of this outbound flight from MAN. Not wanting to get excited, but... if they've settled out on this flight for the same reasons (rudder fault) then I can't see their defense being overly strongI'm doing it myself though so may take a little longer than instructing a nwnf company. Can I be cheeky and ask the amount they agreed to pay? :O

I also tried to explain that any EC claims from Monarch should be dismissed as I had proof that the aircraft had flown three scheduled medium haul sectors without incident since the technical fault Monarch were claiming from 30 hours previous.
I suggested the stay was weighted unfairly in Monarch's favour as they were likely to be witholding their witness statements purposely to see the outcome of the Jet2 appeal, but he was having none of it.
Whilst keeping my composure in the courtroom, I was fuming once outside. It seems that Monarch can mess folk around at considerable expense to the claimant, not bother to turn up, not follow procedure nor have a case to answer, yet a judge can still bottle it and give them a further 21 days to submit statements rather than risk being cited as the judge who has made a decision that could affect several other cases involving this delay claim.
I really have no faith in our justice system now.
If anyone else has any info on the flight mentioned above, or flight ZB685 SSH - MAN 29/09/2012 which was where the knock-on fault occurred initially I'd really appreciate it, as I'm determined to be armed with as much detail as possible when the case is finally heard.
More importantly, I am struggling to work out exactly where the aircraft (G-MONR) went to between arriving in Manchester from Sharm at 10.35am and its revised boarding time of approx 10pm on 30/09/2012. A Monarch employee let slip that it had flown to the Greek Islands but I can't find any detail.
Any info would be a big help.
Sorry to read that our Justice system is frustrating you in favour of Monarch, my wife and I were on the same flight as you. When I received phone call in morning of flight delay from Monarch I looked on teletext and am certain that the delayed flight coming in was not from Aktion but Skiathos, I have looked on flight stats and there are no ZB flights from Greek Islands due in to Manchester on 30/09/2012 with any airline, however I think I may have found flight which could be missing one and it is prefixed MON ( charter flight) however flightstats do not track these. The flight number is MON5624, close to ZB number previously given. Maybe some one can throw light on this flight.

Bazzalad (and Adie) here is Coby's response ..."If it helps, I think G-MONR operated ZB5642 from Manchester to Aktion, Greece on 30th Sept 2012. It was supposed to depart at 07:00 but instead departed at about 12:48. It then flew back to Manchester and landed at about 20:21."

Hi All,
I wrote to Monarch about a flight delay and after hearing nothing I contacted them at [EMAIL="EUClaim@Monarch.co.uk"]EUClaim@Monarch.co.uk[/EMAIL] and they sent me a claim form to fill in.
They responded after only 2 days however stated my claim for delayed flight ZB742 to Malaga 09/10/10 was unsuccessful due to :
"Our records show that an aircraft from within our fleet sustained nose damage caused by a lightning strike which rendered the aircraft unsafe to operate. Consequently, this resulted in there being insufficient aircraft within our fleet to operate your flight on time. However, in order to minimise the length of your delay, passengers were transferred to the first available aircraft from within the Monarch fleet."
From the wording it doesn’t appear that it was the plane being used for me flight was the one that was hit by lightning, does this matter? I cant find any information on claims for this flight.
Also how do I know this to be true? At the time of the delay (6.5 hours) and very little information the only reason given was technical fault.
What have others done in this situation?

I agree with your analysis Squiffy - this doesn't sound like "your" plane was hit by lightening at all.
You need to take your own decisions, but I'm pretty confident such a defence would collapse like a pack of cards if you took Monarch to court.0 -
I've had the standard fob off response from Monarch today in relation to my claim. They dealt with it fairly quickly, I sent the forms to them on Monday. I've gone back to them to question how they can pay out on the ZB532 flight which had the same issue, but not ZB533. I can hardly wait for their response....0

leespot - there are 2 reports where Monarch have paid out either an individual or party on 2 flights but have refused passengers on the same flight. One was my flight where friends who claimed were given the normal fob off even after I was paid out.0
