Hi there.
I was wondering if someone can help.
I flew from Gatwick to Mombasa 23rd March 2009. All flight stats seem to tell me is the estimated departure time, but we did not leave until 7am the next morning. There was some sort of fault with the plane and they had to get a part delivered from Luton, but we weren't told this until about 10pm.
We were given food vouchers but as it was so late at night, most of the airport shops were closed! We were put up in the hotel airport too.
This all meant I missed a whole day in Kenya as we got there on the 24th close to midnight.
What are the chances of success getting a claim in and where do i start?! Flight stats says flight number was zb 2692.0 -

The deadline for responding to my small claim action was 5pm last night. Thomson's defended in plenty of time. when i phoned today 2 ask if Monarch defended she said yes so i asked what time yesterday as they hadnt defended when i phoned yesterday morning. she said they sent an email yesterday but that doesnt count & theyve written this morning. i said well this morning is 2 late so she put me on hold & when she came back she said yes today is 2 late but they will allow them in court & then its up 2 the judge if he allows it 1 day late or not. (Im guessing he probably will, but who am i 2 know)0 -

The courts appear to be a bit lax about this. Monarch sent their defence to court late too. I phoned the court several days after the deadline had lapsed. The court said they hadn't received a defence and gave me the go-ahead to apply for a default judgement. I did, and the court then rejected my application for judgement and said the case was now being defended. As if that wasn't enough, I did not receive a copy of the defence from Monarch. Instead, I rang the court and they agreed to photocopy their own copy and send it to me.0 -
Klint exactly the same as my case then the copy the court forwarded was both unsigned and undated as well as being weeks late but all ignored by the judge who found in my favour anyway. Always worth pointing out at the hearing anyway as judge may take a dim view of the Monarch tactics.0

I'm beginning to get a sneaky suspicion that Monarch's behaviour is perhaps actually planned, rather than being due to pathetic disorganisation. They keep trying to fob off customers with technical faults as an excuse, but they know that's not valid (Wallentin etc) so they don't want courts all over the country to reject their defence due to that, so they perhaps deliberately introduce another way for courts to reject their defence, such as late submissions and not following the correct procedure instead.0

I've been thinking about this too. But I think it is probably 75% incompetence. To be honest, I don't really care: I know expect nothing from Monarch.
The official at my local court thought the judge would take a dim view of Monarch's behaviour (no defence, etc). But it's immaterial really: I'm confident enough in the merits of my own arguments.0 -
Today published in Sunday Mirror figures provided from the MSE.com re flight compensation and the current Flight Delay Payout Table.
Statement from Monarch "All claims submitted to us are resolved within 28 days. The pending figure will therefore be made up of claims made within the last 28 days."
What utter rubbish. I have just e-mailed the reporter who published this and suggested he tries looking at this site and reading 1st hand accounts from customers trying to deal with Monarch. Then and only then will he get a real idea of what it is like to deal with Monarch Airlines. (stephen.hayward@sundaymirror.co.uk)
There is also an item published in the same paper by Dean Dunham a consumer rights champion, regarding How airlines fly in the face of the law. Pretty much basic stuff - but at least its getting coverage.0
