  • Thanks to everyone for all the info on how to proceed with the claims. Have just filled in my forms for ZB228 (LGW-PMA) on 23rd August, that was delayed from 16.55 until 07.00 the following day. Will keep you updated as to the progress.

    Today I received the following in relation to the above flight:

    [FONT=&quot]Our records show that your flight was delayed as a result of industrial action within Greek Air Traffic Control. The strike affected all flights operating in and around Greek airspace. Many areas of Greek airspace were either closed or heavily restricted due to staff shortages. Routings avoiding Greek airspace were used but these were heavily regulated due to the huge demand for this airspace. Some flights were rerouted to avoid the Greek airspace but still had large ATC delays and incurred much higher flying times.[/FONT]

    [FONT=&quot]Having considered the factual background of this case, we are satisfied that the disruption was caused by an extraordinary circumstance that could not have reasonably been prevented by Monarch Airlines. We are, therefore, unable to accept your claim for compensation for the reasons given. [/FONT]

    There was a strike that day, but for two hours, in the afternoon, ours was supposed to be a 10am departure. This is completely different to what was announced on the plane once we were on and the doors closed and we sat there for yet another hour. At that stage we were told that a technical problem of some sort caused a delay, and as a knock on, we had missed our slot at Zakynthos, which is tiny and there wouldn't be room for us. Interestingly, TC and Germania also had flights to Zakynthos from Manchester within the space of an hour of us (one either side I think) and they both got away on time - surely they would have had strike problems too?

    Has anyone else come across being told one thing on the day and another once the claim goes in, and more to the point, how can you prove otherwise?

    Tigger31 although I have little or no time for NEB's this may be one instance where their involvement may assist.

    Alternatively, you should be able to use flightstats to show whether other flights were experiencing delays - if yours is the only one, it's difficult to argue that this was air traffic restrictions (though not impossible).

    From Flight Stats, the 8:40 Germania left at 8:40, and the 11:05 TC left at 13:05 (scheduled after us but left before us). The TC night flight at 23:10 left at 23:23.

    It took the Greek NEB 9 days to send an email to Thomson saying provide proof of extraordinary circumstances or pay up. Pretty goods turnaround.
  • Well, after reading in the MSE Newsletter about the changes in made in August, we decided to try to re-apply for our 9hr. delay back in 2012, on ZB565, three of us were turned down earlier this year, and after re-applying again in August, we got... nothing.

    Should I try the CAA?

    I think the that it was a fault was the nosewheel.
