  • Generally you can't go back to the FO if you have lost your case in court. You can read Martin's article about claiming PPI here and you'll find the link to the discussion threads at the end of the article.

    Must say I have found the FO very frustrating. Hubby put a claim in July against Crap1. Got a letter early August saying they had not had any reply from them after 4 weeks and that they would be writing to give them another 4 weeks. Called them early September to be told still not heard anything. Then called on Friday and was told they had made an offer (but FO did not call us or rush into letting us know). They then sent out the offer. My advice is leave it a reasonable time of around 8 weeks then keep calling for updates. Accepted £862 on a claim of £950.
  • Think I may just follow your advise and keep phoning - it's been 10 weeks so far and not any further forward. :confused:

    can anyone advise of what to put on the FOS forms - simply a run down of letters sent? should I send the copies of all the letter? I've been offered the charges minus £12 from Capital One but want to pursue further.

    On the form, you state what you want, ie charges back, and enclose copies of all letters , which must include the final response from the bank.

    Are you able to claim the £12 fee from Capital One, as they may have dropped it to £12 but what they do is charge you twice to get the same amount back. Once for Overlimit fee and then again for late payment fee. Hence £24.
  • Hi there - have read quite a few success stories with Cap One refunding full charges via the MCOL route.

    Just wondering if anyone had same success via FOS? Being in Scotland I can't use mcol!

    Have accepted partial payment without predjudice - should i get this payment within the 21 days? Are they likely to stall paying this until FOS involvement?

    I'm afraid that you won't get the payment since you haven't accepted it as full settlement - they will just tell you to pretty much take it or leave it.
    I too am in Scotland and claimed the full amount back via the FO and my partner got his back via the courts (small claims up to £1500 will cost you £44) so up to you which route you take but you should be successful either way - FO just takes longer!
