either way bring on the high court judgement, people power has spoken, and if the high court refers to Scots common law, then it will be a truely historic occasion, castella V tyres bring it on0

Most banks won't be paying anything at the moment so its a bit foolish to assume they will just because they may have done in the past.0

I posted a thread the other day asking advice on wether to complain to the ombudsman. I can still put in a complaint based on the fact that the bank took charges from my benefits. Can anyone advise me.. Not all my charges were taken from my benefits. Some were while I was working. Does this mean I can only try and get back the charges taken from my benefits this way ,and get the rest thorough court when the test case is over, or can I jus claim them all now in one go through the ombudsman..
Doea that make sense??? lol
Thanks in advance!!!0 -
Just do your claim for all charges no matter if only some were taken while you weren't working.0

I would think you will need to enclose a letter with your claim explaining, from Martin's Emergency Guide....
What else can I do if I am living on benefits?
A: If you rely on benefits for your main income, such as Income Support or Job Seekers Allowance, there is still possibly a way you can claim; though it relies on a slightly different law. All past claims have been based on contract laws but there is another law called the Social Security Administration Act 1992, which says that banks must not take charges from benefits as this money is needed for a person to live on.
If you are in this situation, contact your bank to tell them that you are living on benefits and it should process your compliant. If it still does not help, contact the Financial Ombudsman, but make sure you tell it that you are receiving benefits and your case will be dealt with. For details on contacting the Ombudsman see the main Bank Charges Reclaiming article.0 -
Can anyone advise me if they have claimed from Crap1 through the FO? My husband got a letter from Fo today saying, usual crap about OFT ruling saying £12 was fair charge blah, blah, blah. Then it says: As you and your credit car company disagree it is necessary for us to look into the complaint further. So that we can continue our investigation, we have today written to the credit card company to ask whether it wishes to increase its offer and if it does not for it to provide information about the level of charges applied and how they were calculated. If your complaint relates to other issues we may also seek additional information from it.
We shall write in one month to let you know that stage matters have reached. If you do not wish to pursue the matter further with us (should you prefer to take legal action) then please let us know as soon as possible and no later that 16 August 2007.
Is this a standard letter? What is their normal response and how do Crap1 usually react? How long does this take?
Thanks.
