Follow the Ombudsmans advice. You will not have deemed to accept anything as full settlement unless you've said so.
Ok now lloyds sent a letter offering £750 as full & final settlement. I never accepted it verbally or in writing and withing 2 days of the letter they've now put it in my account! Which, by the way is the quickest they've done anything for me! I'm worried they might try and claim to the FO that I've accepted offer and thats it, I dont know if I can use the money or not? FO say they've written to lloyds and are still investigating it.0 -

Don't know if I should be posting this on the success thread or not. I received a letter from FOS this morning, dated 26th July, advising that the Bank of Scotland were making an offer on both my accounts. I raced to the Post Office with signed acceptance and sent by Special Delivery (of course!). Advised that it may take 6 weeks to refund. I will post on success thread if and when cash is in my account. Do you think I qualify for payout as offer was made on same day as announcement regarding test case was made? I wasn't home in time to phone FOS and will not sleep tonight for wondering whether I'll be paid out or not.

Ok so i here a brief summary
Original letter sent Jan 07
Got Omsbudman on board straight away
Sent in my highlighted charges Feb 07 asking for my £1600 refund
They wrote back to me (RBS this is) in may saying there charges stand but they offered me £80 !!!! (joke i know) So i told the Ombudman this and they said they would investigate .
I got a letter from the Ombudsman yesterday stating RBS do not accept Liability but nonetheless had already offered to settle at £1554 (Alot better) but the letter stated the bank had already sent me this offer (They hadnt ) So i rang the RBS who said they didnt even have a claim for myself
So I rang the omsbudman and they have said to sign the Settlement letter and they should pay

Just called the FO as dealing with Crap1 claim. Taken 6 weeks so far and they said probably another 6-8 weeks. Surely if the banks are on hold then this should make the credit card claims go through quicker! Not so many people in the system!!!!!!!!!!!!!!!0

I would be more inclined to believe the financial ombudsman than your bank. Perhaps you could write to your bank, enclosing a copy of the letter from the ombudsman and cc'ing the ombudsman in. Tell them that you accept the offer that has been made via the ombudsman and request payment within 14 days.

Three weeks ago Lloyds TSB offered us £5000 in reclaimed bank charges. We had claimed £7,500 but decided to accept their offer as we have been in such financial difficulty and didnt want to wait any longer! We did this through the Financial Ombudsman as, although we had used your template letters all through our claim, we could not afford to take them to court at the end. We presume this test case the OFT have brought will mean we wont get our money back for AGES. Is there any chance we may get it as we had already accepted their offer?? We live in hope.0

yes..if you have had an offer in writing and have sent an acceptance back in writing you will get your money.0
