Thank you lindilou39. We were so gutted when news broke of the test case as we have been waiting three weeks since accepting the banks offer and were nearly there!!!! This money will make the difference between being stressed out constantly and being able to relax a bit and maybe even have a weekend away for our anniversary. Will sleep better tonight!! I was taking my claims to court. In fact I'd onlt posted my pappers to the court the day before the announcment. My dilemma now is I jus found out from Martins latest posting that because my charges were taken out of my benefits due to a slightly different law I can still take my case to the ombudsman because they're not supposed to take it from my benefits. and the ombudsman will deal with it while the test case happening. My problem is. to me the court looked like the easiest way of way and the ombudsman quite complicated, Can anyone tell me if that is the case and advise me of their opinions... Or if I've mis read Martins advice an am way off the mark!!

Have a read of these previous posts from users using the FO, I would say its no more complicated than court and most people have in fact found it easier. If the FO will take your case on I would urge you to contact them.0

I've just been looking at the forms and the thing with the court was all I had to do was print out the letters Martin had prepared although I've only very briefly looked at the forms for the ombudsman it seems you have to put alot of it in your own words and I'm not very good at that. In fact the only reason I went thorough the court was all I had to do was put in the figures.0

Damn. I was at the point of sending away to the FO when the crap hit the fan. I AM NOT AMUSED!
Now, by the time this "Test Case" has been sorted, will I miss out on a shed load of money(assuming it all works out in favour of the consumer), due to the fact most of my claims were from 6 years ago.
Or... Will I be able to just restart my claim at the point of stoppage?(with interest added)
I'll point out, I never actually got as far as dealing with the FO, but just about(7 weeks since 1st letter to bank) and I had just recieved a "fob off" letter.
Either way, looks like it wont be sorted until Xmas at the very least(or am I wrong?) and here was me hoping I'd have some extra cash for my wedding

:mad: My claim was handled by Financial Ombudsman. In beginning of July, the bank made an offer more or less for the full amount claimed. I have accepted this offer, and have received a letter from FO stating that they have informed the bank that I've aceepted the offer, and that I can expect the money in no more than 6 weeks. This letter was dated 17th July. However, I've received nothing from Lloyds - no letter or cash!- and when I contacetd them few days ago they informed me that all payments have been put on hold until test case heard. Is this right, despite them making me an offer that has been accepted??0
