After 2 months of waiting i have just had a reply from the financial ombudsman stating that the bank would rather settle than be subjected to a formal investigation. i dont know how much i will recieve yet as the bank is still calculating the amount.
So here's to all of the people who didnt have any faith in the financial ombudsman, they were really helpfull and it was all pretty simple.
So Ha Ha Ha, another one for the little man!!!!!!!!!!!:T :beer: :j0 -

Hi Angiebabe,
My claim is with the FOS from the Bank of Scotland. It is now nearly 6 weeks since I passed it over to the FOS and I received a letter from them on 10th July, ( nearly 3 weeks now) saying that they had contacted the BOS. What was the timescale for your result? I am getting a wee bit panicky that I am going to be the first that the FOS can't help. This has been going on since 16th January, when I first asked for statements.

Have been too-ing and fro-ing with First Direct re: Bank Charges of nearly £7000 on 2 accounts since April '07, contacted the Financial Ombudsman Service who are currently dealing with my case.
Today I receive a letter with an offer from First Direct for £5580.00 should I settle or go the whole hog?
Part of me says 'you had nothing so accept', but the other part says 'they have taken hard earned money from me so go for it'?

Hi guys have been following the advice on here and trying to claim back $3400 from lloyds tsb. Was a little worried as they Lloyds seem to let it go to court.
The Financial Ombudsman have taken on my case after Lloyds didn't respond the 3rd letter. Anyway Financial Ombudsman have had all the info for about 2 weeks ( they said would probably take around 8 ). Yesterday received letter from lloyds with " sorry you disagree with charges ...etc) and goes on to say " on this occasion we are able to refund $750 as full and final settlement etc, will be paid into your account withing 10 days, if you're still not happy we recommened you contact finincial ombudsman etc" So I thought well thats a start. Opened next letter in pile of post, exactly same drafted letter but offered $22 as full and final settlement etc.
Ombudsman said not do anything yet, they have just written to me and said they have requested my file from lloyds. So these letters look like lloyds have sent them of their own back but not sure if i accept the payments into my account does that mean I've accepepted this as full and final payment from them? and they are not liable to pay me anymore? I expected Lloyds to hang on till last minute or to let it go to court? Has anybody come accross this before?0 -

Follow the Ombudsmans advice. You will not have deemed to accept anything as full settlement unless you've said so.0 -
hi everyone, im new to this forum site but looking for some advise.... i have started the long battle of re-claiming back bank charges, and i am at the step before the claims court. I read that they only deal with claims up to £750 in Scotland - im looking for over two grands worth!!
I think my next step looks like going to the Financial Ombudsman - has anyone got this far, and if so were you successfull?

FO is a good route for Scottish claims, lots of people have already been successful.0 -
I live in Scotland and successfully got my money back (well I will have soon!) from Lloyds via the FO - so I'd say to try them.0
