    Hi Trace,
    Looks like it's a race between you and I as my letter is dated 10th July too!! Everyday I'm hoping the postie will bring some glad tidings, but no, same old bills and junk as usual. Keep me informed,

    Hi Everyone
    Glad to hear some people are getting some help from the FOS. We haven't.
    Sent them a complaint against the Bank of Scotland in Nov 06 and it still hasn't been settled yet.:mad: :mad: :mad:

    Our complaint involves charges, maladministration, breach of the Banking Code, contract law, data protection, not being nice people and a whole lot of other issues. Think i will blame them for the s£*t weather aswell.

    Seriously, we have found them very difficult to deal with from the start. We have sent masses of evidence against the BOS and the adjudacator for our case still doesn't think the BOS has done anything wrong. We have asked repeatedly for a personal hearing on our case because of the number of issues involved and they will not grant one. We sent copies of the BOS own internal files on our accounts showing that they lied to us and the FOS but still they say they cannot uphold our complaint.
    The BOS even missed the cut off date the FOS had set them for the return of information requested (i have evidence of this) and still the FOS hasn't settled our complaint.:mad: :mad: The only reason the BOS ever got back to the FOS was because i hassled some poor lady at the head office.:rolleyes:
    Ever get the feeling that no matter what you do it aint good enough.
    We think the FOS are deliberately trying to protect the bank as we think there is enough evidence against them for us to win a court case but if the FOS do not uphold the complaint then would a court? :confused:

    I do know that you can't go to the FOS after losing in court, but you can go to court if the FOS does not get you any satisfaction.
    Just hope mine doesn't take as long, it's with The Bank Of Scotland, going through the FOS.
    I would agree, the BOS are one of the worst to deal with, especially their stalling tactics. And yes it is their fault for the weather!!!

  • Wondered if anyone can offer any advice, I've been and used the template letters and had sent the last warning letter to barclays i.e. will go to court if they don't reply in 2 weeks.." they sent back a letter stating they would get back in 4 weeks or at least no later than 16th of July.
    I am not in any particular rush, gave them the benefit of the doubt (and even gave them an extra day due to postal strike) nothing arrived from Barclays! So late afternoon on the 17th I contacted the FOS to check out the postal details, and sent them the complaint forms and copies of correspondence.
    Then it's just typical that i finally get a letter from Barclays the day later! offering £510.00 (original figure was £867.20 including the interest)
    Not sure what to do I know that accepting a part offer is personal preference, but not even sure if I could just accept the offer now as I have already sent the complaint to the FOS?!
    Any advice please?

    Go to the FOS, claim every single penny they owe you, if you incurred £200 of charges this month, would the bank accept £134...no....they would want all of it. remember this is YOUR money, do not let them off

    Hi Everyone
    I recently wrote to Nationwide Building Society to try and claim my charges back but they wouldnt pay up! I decided that i didnt really want to take them to court, i was abit scared to tell the truth! so i phoned the Financial Ombudsman who very quickly sent out some complaint forms to me.
    I filled these out and they were really simple, sent them back and waited. A couple of weeks later i recieved a letter stating that they were looking into my complaint and that as soon as it was resolved they would contact me again and true to their word two weeks after that i recieved a letter offering me a settlement. The amount offered was the full amount i asked for!!
    The Financial Ombudsman dealt with my claim quickly and efficently and i could not be happier with the service provided.

    For all those out there who are abit afraid of taking on the BIG GUYS do it through the Financial Ombudsman!!!!:j :j :j

    have you had your cheque yet, I had a full offer on the 14th, but it said it may take up to 6 weeks to get my cheque

  • Hi I need some more advice please, I wrote my 1st letter to Lloyds TSB in March, they sent their standard 'our charges are legal' letters. I replied with Martins template letter threatening court action if my claim was not settled within 14 days this was May 12th I am still waiting for a response, I have telephoned a couple of times and eventually got through, the 1st time I was told they were allowed 52 days to contact me the 2nd time I was told to wait a couple more weeks, they have also sent me information on how to contact the Ombudsman as they realise I have been waiting sometime for a response. the last time I spoke to them I was told my case was being looked at and should hear in a couple of weeks. As the 2 weeks have now passed I called again today and finally got to speak to someone who has told me that my claim was caught in a batch that has passed the acceptable deadline and I should go to the Ombudsman as that is the only way my case will be looked at now :mad: He said I could go down the court route but would be quicker and better for me to go to the Ombudsman? I have no idea which way to go - I am relcaiming £621...
