nobody can answer that apart from you.i would say they MIGHT be able to use that against you in court.find out how much it'd cost you to take them to court and then make YOUR decision.good luck0

Hi all,
I have successfully claimed against Lloyds TSB on 3 occasions before (for my sole account, my husband's sole account and our joint account) and got back all the money plus interest.
However as we still have the accounts and although I try not to ever so hard we have still been charged twice since then. Once when a cheque written by me would have taken us £7 overdrawn they returned the cheque and charged us £35 (this was despite the fact that I transferred the money over at 10.15am that morning!) and secondly when we went overdrawn by £10 whilst on holiday.
Because the court route was mighty stressful I have thought about trying to reclaim the money through the ombudsman. I should send the first two letters (requesting the money back and then threatening legal action) but then what should I do? Do I then contact the Ombudsman? Has anyone done this before and can they help me through it? All advice gratefully received!0 -
If I got a pound for every of my answers lost through merging threads while I respond....
Basically, you have to give the bank 8 weeks before you contact the FO, unless the bank contacts you earlier, saying this is their last word and advising you to go to the FO - then you can go there straight away.

My orginal claim was for £2200 and I received a letter today stating that they will pay a goodwill payment of £758.50 and that the money will be deposited into my account and I have 14 days to reject it. I checked an lo and behold the money was in my account. I called them straight away and told them that I wasnt accepting the payment, they then offered me £1100. I decided to reject there offer and I am now going via FOS. This maybe a gamble but I am willing to go all the way with this one, I find the Bank of Scotlands tactics very sneaky and if I touch the money that is laying in my account it is resulted in payment.

No, the FO is is the Financial Ombudsman and OFT is the Office of Fair Trading, two totally different things.
There seems to be a bit of an urban myth about the FO and the difference between £20 and £12 as you can see from this quoted post. In fact one MSE user, whose name escapes me sorry, his FO advisor has asked Egg to justify why they charge £16.
