    I was just wondering if it would be ok to Reclaim Bank Charges again after having successfully reclaimed before?

    Im with Capital One who eventually refunded my Over Limit & Late Payment Charges.My account went down to zero but I needed to go back into it as I needed it to pay for the food shopping & a bill but I made sure that I didnt go over the £200 limit but because I didnt pay the £5 minimum payment they have now started to charge me again of £12 Over Limit & £12 Late Payment Charges.

    I know I shouldnt have really gone back into spending it,I should have just closed the account but I needed it to pay for the shopping & a bill as I had nothing else.

    They have sent me a letter to say that if I dont pay it within the set time limit they will Eg:Close my account,Will have to pay the whole balance,Notify credit Agencies,Sell account to a Debt Collection Agency etc etc.

    They are saying that I have breached my Capital One Credit Agreement by going over my credit limit as described in clause 4 of the agreement & giving me a time limit to pay etc etc...

    Im over my limit by £88.54 which they are asking me to pay by 8th Feb or they will carry out the above.

    The thing is about £80 of this is the Charges they have applied.

    What shall I do? Should I pay it then claim it back? If I pay it its going to be coming out of my Incapacity Benefit in which I get £122 every 2 weeks.

    Do I have to start all over again with the first letter asking for the statements?

    Any Advice/Answers would be much appreciated,Thank you.

    Nothing stopping you going through the same procedure and claim your charges via the courts, but Halifax will say they may close your account.

  • Regardless of the whole reclaiming thing, there's one thing I'm getting confused about which I think might be a weeeeee bit naughty, but I'm not sure.

    Recently moved house, and expenses incurred pushed me passed my authorised overdraft, resulting in charges. Because my card etc continued to work however, I didn't realise and subsequently incurred 5 charges at £30 each, a whopping £150.

    I transferred some money into my account between the charges being made and being taken from my account, but the total amount still made me overdrawn again. And the next month, I had another £150 taken in charges, because they had charged me for each of the charges that led to me becoming overdrawn in the first place. This has happened about three times now, and unfortunately makes it impossible for me to actually live off of my current income without spiralling deeper into charge territory.

    Unfortunately, before the test case came up I had applied to reclaim my charges and in that time had got a stop on a similar spiral of expense, and apparently I;m only allowed to do that once.

    Basically...

    If a bank charges you, and the charge is withdrawn at a time you have no money, making you overdrawn again, is it actually permissable that they charge you again?
  • Hello all, I claimed back some bank charges of around £700 from HSBC and got the full amount after around 3 weeks...

    Waht do people think the chances are now of claiming back so recent charges?

  • Hi I'm new here and need some advice
    I successfully made a claim to recover bank charges from the Halifax up to December 2006 and issued proceedings online in March 2007 and Halifax duly paid up the amount claimed plus court costs and interest
    However all the time since December 2006 up to now, they have carried on charging me for going overdrawn each month, and it has now mounted up again. They never actually cleared in full
    My question is; can I re-start the previous proceedings or do I have to start over from scratch?
    Any help greatly appreciated

  • ...with halifax to the tune of £1200 after having a huge arguement with a real ball busting woman who only wanted to refund me half of that, I have been very careful with my account ever since in order not to have to do this again....

    Unfortunately this month i forgot about a quarterly £8.50 DD and have a had a letter to say £35.00 bill for it (2 days before pay day as well!), if i ring up tonight with the "its only £8.50" type way do you think they will waive the fee this time or is it likely to flash up that i gave them jip last year so now they are laughing at me...??

    I think you have no chance, the same happened to me last week, forgot about a quarterly dd, went out on the 18th off I go to the bank to deposit some money to cover it. Got a letter a few days later with a £35 charge, rung them up and they said the dd went out at 03.00 am and your money went in 10.00- to late, got to be in the night before. :mad: :mad: :mad:

    Asked for the terms and conditions, and I can't see where the rule is even :mad: :mad: :mad: :mad:
  • i claimed my bankcharges back about 18 months ago, but due to me loosing my job we keep having dd bounce, the total last month was around £450, is it possible to re-claim them back again, and is it done in the same way, i bank with the halifax,
