im sort of new to all this as well, im wth abbey too n the 40 days are up on 14th may for me, i have sent off second letter wth comments from this forum, also stating that they have till the 14th then i will report them to the IC. i have only had the usual 1 yrs worth of statements frm them so im also waiting n wondering what to do next.....

Hello, im quite new to all this too but i think once the 40days are up (40days straight from when you sent the letter) weekends, holidays included!! Send the next template letter (Telling Abbey they have failed to provided the requested information and have now breached your DPA rights and therefore if you do not hear from them in 7days you will report them to the Information Commissioner) send recorded too!! http://forums.moneysavingexpert.com/showpost.html?p=3585449&postcount=7 o you could just report them to the IC
I also emailed them and after 78days finally recieved my statements

OK AM WANTING CLAIM ALL BANK CHARGES ROBBING ABBEY (NATIONAL ) HAVE ROBBED ME FOR 6YEARS WISH IT COULD BE MORE AS I HATE THEM SO MUCH AND BEEN WITH THEM AS LEAST 15+YEARS AND HAVE NEVER OFFERD ME ANY THING ONLY A O/D SO IVE STARTED THE BALL rolling by sending a £10 cheque to abbey stating 6years bank charges use the template letter here thanks had a letter a few weeks later saying usal rubbish we are investigating your complaint RUBBISH and so i waited for my six year statements had a letter from abbey saying thanks for your recent enquiry requesting information on bank account also acknowledgement receipe of your £10.00 fee then the letter stats the transactional information remaining on our systems normally covering the LAST FOURTEEN MONTHS WILL BE SENT OU IN THE FORM OF INDIVIUAL DUPLICATE STATEMENTS AND A STUPID SUMMERY OF CHARGES DEBITED FROM YOUR ACCONT BACK TO JANUARY 2004 SO after reading this letter i was so mad i rang them up asked for the person whos name is on the bottom of the letter as says if i have any questions to call the number above on my letter which i did after 30mins on hold i got to speak to someone who was no use what so ever and COULDNT OR WOULDNT HELP ME OR PASS ME ON TO A SUPERVISOR OR MANAGER SO I ENDED PHONE CALL AND RANG AGAIN SPOKE TO ANOTHER PERSON WHOS ENGLISH STUNK TOOK 5MINS JUST FOR HERE TO SPEEL HERE NAME FOR FUTURE COMPLAINT AS THIS TIME AFTER ON HOLD I WAS IN TO 50MINS WHICH IVE GOT TO PAY FOR SO WANTING TO CLAIM THIS PHONE CALL BACK ASWELL AS SHE WAS NO USE AGAIN AND JUST PROMISE ME 6YEARS STATEMENTS WOULD COME THIS WEEK WHICH THEY DID BUT ONLY 14MONTHS SO SOME ONE POINT ME IN THE WAY I NEED TO GO TO CLAIM PHONE CALL BACK THAT WAS A WASTE OF MY TIME AND MONEY MAKE A COMPLAINT ABOUT THE TELEPHONE GIRL THAT I COULDNT UNDERSTAND AND HOW TO GO ABOUT CLAIMING ALL MY CHARGES I GUESS IS A FEW GRAND AND WANT TO BE A RIGHT SOD TO ABBEY AND ADD 8% ON ASWELL ALSO ANY ONE WITH ABBEY ADDRESS THAT MAY GET THINGS MOVING FASTER AS ABBEY FIRST 40DAYS UP IN A WEEK AND OTHERS AT WORK NEVER HAD THIS MUCH TROUBLE I HATE ABBEY :mad: :mad: :money: :mad: :mad:0 -
Hi,
I can Imagine what you are going through right now as I have had a similar banking experience with Abbey and Last year I managed to get 3 years worth of charges back, but I had to start court proceedings to get it.
I believe what you need to do next is wait for the 40 days to expire and then write to the Abbey and The Information Commisioner (I think thats the right place) and point out that Abbey havent sent all the information, and that the Data Protection act covers information held on microfiche and that this is an offical complaint that they arent adhering to the data protection act correctly.
I think they would then quickly get the remainder of your statements to you.
Alternatively you could just ask them outright how much you have paid in charges over the last six years, they probably have this on their computer system, but its different to asking for copies of statements. This will give you the amount you need to put in your court claim, BUT you will need your statements as evidence.
If you cant find any further info in these threads, try the Consumer Action Group, lots of people there on the Abbey Charges Hell Forum!

what nextalso forgot the statements the gave me for the 14months dont show any charges but got last couple of months statements that have got charges and intrest charges0

I feel your pain ...
If, as seems likely, you haven't received the information you require by 40 days from the date they received your request (which is why these should be sent by a method which records this - if not, use the date sent plus 5 days, like the courts will do when they serve your court claim), report the matter to the Information Commissioner.
And if you think the banks are being obstructive with the statement requests, just wait until you actually send your claim letters and start court proceedings!The acquisition of wealth is no longer the driving force in my life.

Sorry, I just thought id get it off my chest..
to the point, what do you do when the bank simply WILL NOT supply you with your bank statements???? Ive asked ABBEY 3 times, gave the 40 days etc. Ive sent the letter to the ombudsman and heard nothing. Im obviously going to send the two week acknowlegde or court letter soon, but do I have to wait until i receive the exact figures??? i have statements going back 4 and a half years but nothing after that. Has anyone ESTIMATED this??

You need to escalate your request to the regulator for the Data Protection Act, the Information Commissioner.
You cannot expect anyone to even consider repaying any money you claim they owe you, if you cannot give them details of this.
Of course, the banks know this and this is onlythe first round of delaying tactics. Just wait until you do send your claim letters and take them to court!The acquisition of wealth is no longer the driving force in my life.

Have you tried emailing them? I waited 78 days for my statements then i found emailing them helped..kept annoying them with emails and my statements turned up.0
