Abbey statements

    i'm trying to get my statements for the abbey and sent them the template letter. 41 days later i rang them and told them i had only recieved only my last 12 months worth. their reply was that they have 40 calender days to reply which gives them 8 weeks!! Stunned i said i'd ring back on monday!

    so is it 40 calender days or 40 working days?

    also, if i had my statements now i could claim back to Sept 01, but cos i may only get statements in 4 weeks time, does that mean i can only claim back to Oct 01?... 6 years from the claim sate! if so, i lose a months worth of possible claims because the bank is working very slow. is this correct?

    ps.... grrrr@ the abbey

    You mean they said they had 40 WORKINGS days.

    40 WORKING days = 8 weeks

    40 CALENDER days = just under 6 weeks.

    There are so many people doing this at the moment that virtually all of the banks are exceeding the 40 'whatever' days anyway.

    Hiya Steve,
    Ring them Monday & tell them you are reporting them to the Financial Services Ombudsman (FSO), as they are in breach of the data protection act 1998.

    You can get your last 12 months or so back from Abbey for free anyway as they haven't archived them yet. I got all mine from previous 12 months wothout any sort of charge or having to request under Data protection act.

    So basically all they've sent you is the easy stuff.
    "A bank* is a place where they lend you an umbrella in fair weather and ask for it back when it begins to rain."

    (*Unless it's Santander. The branch says they sent you an umbrella 3 times already and don't understand why you don't have it yet and want it back right now!!!)

  • i have writen to the ABBEY twice now requesting my statements for the past six years and both time i have only recevied a years worth on both accounts which i believe they are trying to use delay tactics hopeing i will give up and go away....before i write again to the ABBEY requesting the same again for the third time, should i write to the bank ombudsman and complain about the treatment ??????????

    Hi knowyourroll,
    As long as you have copies of your letters and proof of recorded delivery, you can definitely take them to the ombudsman, they are breaking the law by not giving you your statements. You don't have to write to them again, let the ombudsman take them on.

    Despite sending the standard letter (provided by this site) to the
    Abbey back in July, requesting details of all bank charges incurred over the last 6 years, I still haven't received a reply.

    Was I right in thinking that despite the test case being held in January 2008,
    they were still required to do so?

    Can anyone advise what the next step is?
  • You are entitled to these under the Data Protection Act within 40 working days regardless of the test case. There is a halt on claims only and this does not affect your rights to have this information. Are you registered for Internet Banking? It may be a lot quicker to register and then access your past statements this way.

    Hi Jaffrey,
    The Shabbey are obliged to send you all of your statements, if you made the request in writing and paid them £10. Your next step is to contact the Financial Services Ombudsman (FSO), and give them details of when you requested your statements, also if you sent your letter by recorded/signed for delivery, give them the details off the receipt for this.
