I'm afraid I am thinking the same. I do know a man who was living with his wife and spending every weekend with his girlfriend in another town. Wife was told he was working/visiting family -Girlfriend believed he worked in the week long hours in his home town.

Both women were oblivious as he told them both a tissue of lies.

If you have not met the "ex"-wife and his children OP I would be very cautious.

from what I know of the CSA, they get involved automatically when the PWC is on certain benefits hence him settling any maintenance by cash informally is crap-ola I am afraid if this is the case.
The CSA would never wear an informal arrangment such as that if benefits are being paid: they will want to assess his payments to them and charge him a crippling amount of money IME, this should then PROVE his address as clearly they wouldn't have ever accepted his address was/is the same as the PWCs.

There's your solution: no need to thank me.

The CSA do not automatically become involved if the PWC is on benefits, this did used to be the case but no longer.

Did I misread it or were the "children" actually adults and too old to be on mum's benefit claims?

Thanks for that caz: new info to me as I was assessed under the old rules and my perfectly legitimate (and affordable) maintenance agreement was overturned and increased by 500% overnight!

I am pleased they changed it as it was quite dictatorial when other arrangements were already in place although in this particular case it seems that it would have helped all parties in their particular predicament?

  • Thanks for all your advice folks. The wife has been told by HMRC that they have concluded their investigation and need no further information. Rather incredulous I'm sure you will all agree......

A friend needs to prove that he hasn't lived with his wife for the last 8 years while she has been claiming working tax credits (two children). He has been paying cash for rent and has no written agreement with the landlord. All payslips, bank statements, insurances etc have been posted to wife's address so IR are claiming he was resident there fore past 8 years and she/they will have to repay tax credits she was not entitled to. We have been trying to think how we can prove he was not resident but as he has nothing in writing to say he has lived elsewhere for that period it is impossible. Any thoughts or suggestions? Thanks in advance.. :o

That, imo is the telling statement that belies the rest of your statement!
