  • I'm not sure how they blocked the IMEI number straight away? Or did it take you a while to sell the phones on?

I certainly didn't expect to be called a fraudster.
    Seriously?

You admit to committing fraud, therefore you are a fraudster. Nothing to debate.

But you are, that was your intention the whole time, to commit fraud. What else would you call it?

Can they really claim i had no intention to pay!? Surely if i lost my job and the means of paying that is something i can argue?

As you lost your job BEFORE you signed the contracts then NO, it's not something you can argue. How can you argue that you did intend to pay when you had no money to pay with because you had no job?

Silk, the OP did not steal the handsets, they were legally his to sell on, or do as he wished with, from day one of the contract. The issue is breach of contract with the network and breach of contract with his ebay buyers. Both civil matters.
    Hi Macman,
Understand what you are saying as far as a normal situation would be within a contract.....however the phones were ordered with intention to default payments rather like theft by deception.

Either way She (I assume the OP is a She with a name like Georgia and talking about boyfriends) should have realised what would happen and be prepared to accept the penalty
It's not just about the money
  • Is there a possibility you lied on your application about your income to secure the phones in the first place? I find it a little difficult to believe you were accepted for 2 iPhone contracts without a job...

There is a potential they put a block on the phones before you sold them as networks will sometimes request further proof of your financial situation or ID after being accepted before they activate the handsets. It does seem a little alarming that they would willingly allow you to take 2 contracts out without the means to pay your bills.

Your intentions were wrong and these sort of actions, much like skipping a train without paying, have an impact on costs everyone else pays. As a result you won't get much sympathy for your actions.

You have no real way out now. You owe 2 buyers their 1000 back and if you are lucky once you have got the two phones back EE might take the phones back and cancel the contracts. I doubt you will now get this though since the phones have been opened.

Losing your job before or after makes no difference-it does not invalidate your binding contract.

Let me get this right. You have defrauded the mobile company by ordering phones you have no intention of paying for and you are upset because they have blocked the phones you have sold on eBay?

I am lost for words and you my dear are scum plain and simple.

I'm not feeling a whole lot of sympathy from these responses

Did you really expect any sympathy after admitting you stole 2 iPhones??!

Well, I think what I was going to say has already been said, so I won't say it, but what I will say is good luck!
