    Hi I’m trying to claim back late payments of Sterling Credit, this is a loan I had out a few years ago and has been paid back in full. I sent my first letter of 05/04/07 form my default charges received them 24/04/07, I then sent my second letter of 24/04/07 asking for £272.76, this is the letter they sent back today 02/05/07, what should I do next?

    Thank you for your recent contact informing me of your complaint. I am concerned to learn that you are unhappy with Sterling Credit Ltd and the administration costs debited to your account.

    I have taken this opportunity to review the background of your complaint and have given careful consideration to the comments you have made and all of the information available to me. Having completed my investigation , I am unable to uphold your complaint and have summarised below the basis on which I have reached this decision and hope that my explanation clarifies matters.

    Default charges are charges payable if customers do not make the required minimum payment by the due date, if they exceed their credit limit, or if, payment is not made on time, or is returned unpaid. The amount of these charges, and the circumstances in which they are applied, is set out in clause 6 of the terms and conditions of the agreement and the customer tariff of charges sent to you from time to time as revised. We believe that Sterling Credit Ltd's charges to customers are fair and reasonable.

    In April 2006 the OFT published the findings from it's enquiry into default charges payable in respect of credit card accounts. Sterling Credit Ltd has carefully considered the OFT's publication but does not accept the principle that its findings apply to your type of account. Accordingly, I regret that we are not prepared to make any refund of the default charges payable or provide any compensation.

    It is important that your issues are fully addressed. Therefore, if you have any further queries relating to this matter, or remain dissatisfied, place do not hesitate to contact me and I will arrange for your complaint to be escalated. Alternatively, you may follow the steps detailed on our internal complaint procedure, I would also like to advise you that unless I hear from you within the next 8 weeks, I will assume the matter is resolved to your satisfaction and my files will be closed.

    I have sent my claim to the RBOS and requested statements from Capital One for my husbands card (which he no longer has). We had a secured loan which we paid off when we bought our new house. The company is Endeavour Personal Finance. Can I claim back charges on a secured loan? Any advice on this would be greatly appreciated.

    You could simply ring them up and ask them for the cash back, that would be step 1. You more than likely will get a no, but then you know where you stand on this.

    Just remember to have all the information that you need to fight them, such as the unfair charges etc. I had this when i rang the bank about a £12 late payment fee on a natwest credit card, when i send the payment 3 days earlier from the natwest credit card payment option on the natwest bank website.

    Out of interest, a question for Fedup and Missc - have you sent your letters recorded delivery to the Complaints Dept/head office in Nottingham.

    I also have huge problems with them so am interested to see how other people are treated by them and deal with them.

    i sent the said letter to my local office (ones who harrass me) over 1 week ago and still no reply!! my letter was ace as well - pm me your email address and if you fancy a laugh can email you a copy from work tomorrow. its a good read

    there a bunch of cowboys - robbing gits who when challeged heavily back off for a bit then rear there ugly head again

    Hello all,
    I am one of many others who are processing claims to reclaim unfair charges. I am currently looking at taking Alliance and Leics to court over their refusal to refund over £700. I am also looking to tak a company called On:Line Finance to Court over £400. They have said that my debt with them was a "Conditional Sale Agreement Regulated by the Consumer Credit Act 1974" therfore, it doesn't fall into the same category as reclaiming bank charges. Is it correct that a "Conditional Sale Agreement" is different? Anybodies advice on this matter would be appreciated!! Cheers!!

    I am trying to sort out my sons finances one being with Welcome finance. He took a loan out with them a few years ago, defaulted on payments and now owes three times as much as he borrowed. I considered asking them for a statement of his account showing the original amount borrowed, with payments he has made and charges that they have put on. Could I do this under DPA. Also I have noticed some people talking about requesting a CAA. Could some one tell me what this is and would it be worth asking them for it. These are loan sharks of the worst variety and I feel very strongly about the way they treat young people. Is there anyway I could force them to court(they keep threatening my son with it but I doubt if they will because they know they could lose when thier tactics are exposed. Has anyone any advice about the best way to go about it. Would I need to enclose £10. Would a postal order or cash suffice as I'm a bit wary of sending them a cheque with my bank details on. Any advice appreciated.

    From the information I have been given in the past concerning loans, you can send the same templates and just amend any wording that you feel not relevant.

    Just send them the template for letter 1 asking for the statements under the 40 day Data Potection Act. You could send them a £10 postal order, that way they do not have your bank details. Alternatively either call them first and ask if they charge (as it does differ from lender to lender).
