Being a bank, or not being a bank is immaterial. Your loan (and the company who issued it) has to comply with UK consumer and credit laws.

    So yes they are reclaimable.

I have treid to get charges back from Sterling Credit and the werent for budging. I have not taken it up with the FSA as i feel that it is unfair to charges £18 for sending a letter or making a telephone call to me to tell me I was in arrears.I have received a letter to say that they are looking into it and will get back to me within 14 days when they have looked at my case. Update you when i geta reply.

The chances are you will be waiting much longer than they say.

No sure if this is of use to anyone, but I got a lounge suite on HP 3 years ago, paid by direct debit (couple of late payments) but nothing major, then ran into problems contacted them with final payment, they refused, carried on harrassing me by phone and letter, told them I could not pay, then decided to ask for a statement WELL WHAT A SURPRISE, I worked out that I had paid the original HP together with interest and the balance they were harrassing me for was for "sundry debt" charges of £10 and £20, I presume the £10 were for phone calls and the £20 were for computer generated letters, up until 31/10/06 they had charged £360 in £10 charges and £360 in £20 changes, which is £720!!!!!!!!!!! They are still sending me letters and the latest one arrived last week, so if you calculate the letters I have kept since then it comes to £600. I keep on getting the same old letters. I have contacted repeatedly saying I am not going to pay and if they want they can take me to court as I would welcome a judgement on this, but the letters just keep on coming. Has anyone had the same problem?

I bought a lounge suite in 2004 and have just done a quick breakdown of the statement they sent me with charges until 31/10/06, the HP was £920 with and upfront interest of £514.24, plus all interest charges until 31/10/06 comes to a total of £1533.18, I have paid in total £1548.06. They have also charged me £360 in £10 sundry debit charges as well as £360 in £20 sundry debit charges, which makes a total of £720 and if you calculated the letters I have received since 31/10/06, the last one being 08/05/07 which is 15 letters and I have lost count of the number of phone calls, this should come to around £400, comes to a grand total of £1120 ALL IN SUNDRY CHARGES. I think this is disgrace full. Your advice and comments would be appreciated

    Hi
Just read your post. Paragon are an absolute nightmare ! We took out a loan in 1998 for £1,500. Got into financial difficulty a year after that so went to CAB, who wrote to all our creditors re. future payments. All were fine except Paragon. Still paying £40 a month ! We wrote to them 12 months ago following further advice from CAB to claim charges back, They charge £20 per letter and £10 per phone call. Guess wot, they haven't replied ! I have recently contacted the Financial Ombudsman and sent complaint. Waiting to hear from them. Think you should too.

    Good luck.
    :D

    Successfully claimed so far:
    Co-op Credit card £75.00
    Cap One £200 for O/H
    Barclaycard: £108
    RBS: £290
    Cap One: £126
    HSBC: £338.50 for daughter.

I have already complained to OFT and they have replied and sent me a letter giving them permission to use my details in contacting Paragon, so I hope if more complaints something will be done. They are still contacting me though on a regular basis even though I have asked them to stop. I would suggest you get a statement of your account like I did and what you have actually paid if you are still paying them, I stopped paying them when I worked out that I had paid the loan plus interest.
  • Think I'll wait for reply from Financial Ombudsman now. If they decide to act on my behalf they may request a statement themselves from Paragon. If they cannot act on my behalf I will then get statement myself. Yes we are still paying each month £40 (but not for much longer). When we wrote a year ago requesting the charges be dropped, they didn't bother to reply.

    Hi All,
I've recently been trying to get an account statement from CNH capital (ongoing from last month!), only to be told that they don't do statements.
Fair enough I said, but you should still be able to provide me with a list of the payments made on the account.
3 phone calls later after being told the same thing each time, I went through the same argument and stated that by law they are required to keep this information for at least 10 years (not sure if this is actually true), so why can't it be supplied to me.
The lady's manner towards me changed, please hold and I'll talk to my supervisor.
When she came back to me she said that her supervisor would sort something out fo me and call me back.
The next day I received a letter saying that I could have a statement of account (even though they don't have the facilities to do this), for £35.
Does anyone know whether they are allowed to charge this or can I say that I'm only prepared to pay £10 as the statutory charge for this info?
    Thanks for any help.
    Louise

    Please anyone?
