    If the charges are a penalty rather than a charge for a service then yes you can.
    Hamsters have no tact and diplomacy, nor do they want any.

    Hi All,
    I've recently been trying to get an account statement from CNH capital (ongoing from last month!), only to be told that they don't do statements.
    Fair enough I said, but you should still be able to provide me with a list of the payments made on the account.
    3 phone calls later after being told the same thing each time, I went through the same argument and stated that by law they are required to keep this information for at least 10 years (not sure if this is actually true), so why can't it be supplied to me.
    The lady's manner towards me changed, please hold and I'll talk to my supervisor.
    When she came back to me she said that her supervisor would sort something out fo me and call me back.
    The next day I received a letter saying that I could have a statement of account (even though they don't have the facilities to do this), for £35.
    Does anyone know whether they are allowed to charge this or can I say that I'm only prepared to pay £10 as the statutory charge for this info?

    Hello there

    Requested statements from Black Horse regarding secured loan 28 days ago(now paid off)

    I was charged a fortune for missing payments etc hence my request.

    Anyway , they just phoned me to say they are looking into although it is different to Banks as it is a credit agreement ? they said they will be in touch once they have looked into !

    Can someone in the know advise me if this is just them being difficult / scare stories etc or am I not allowed to claim loan charges ??

    Yes you can claim as loans come under the same consumer laws as the banks.
    Hamsters have no tact and diplomacy, nor do they want any.
  • I have now received the court allocation questionnaire and the defence from Close Motor:
    1) the defendant admits the existence of a Regulated Consumer Credit Agreement between themselves and the claimant dates entered into a Hire Purchase Agreement with the defendant for purchase of....(car, amount, date, agreemtn number)
    2)Under the terms of the agreement a deposit of.. was paid. Balance payable £.... in 48 consecutive payments of£...
    3)Claimant admits that the aforementioned contract provides for the defendant to claim costs incurred as a result of any breach of the agreement by the claimant
    4) the Defendant will rely on the agreement at the trial of this action for its full terms and effect
    5)It is denied tat the sums referred to in the Particulars of Claim have been paid by the claimant to the defendant
    6) The defendant will demonstrate that all monies paid by the claimant to the defendant are monies repayable under the Regulated Consumer Credit Agreement
    7)The defendant will say that the claimant is on notice that the sums he has paid have not been used for the purpose he claims as he has never paid more than those sums due under the agreement. The claimant is therefore aware that his claim is unreasonable
    8) The defendant therefore seeks all cost incurred in defending this action from the claimant in accordance with Civil Procedure Rule 27.14(d) in that a claim for monies not paid in unreasonable
    9)Save as the same are admitted or not admitted above, the defendant denies each and every allegation set out in the Particulars of Claim as if the same was set out individually and individually denied.

    Basically it seems they are saying that:
    since these charges were in the original agreement which I signed they are lawful;
    they say I have never paid them - I assume that means that they have been added to my account and I have not actually given them more than the monthly payments they were due and therefore my claim is unreasonable
    they want their costs out of me.

    Any thoughts?

    Must file the document with the court by 26th May
  • Can I claim any charges made to me by the finance company that I have bought my car with as they are charging me really highly?

    Can anyone elighten me about this please?
