    Hi

    Ive got a 4yr car finance agreement,Ive had it for over 2 years and is bound under the consumer credit act 1974 etc.

    Ive had a couple of instances when ive had a DD return and the finance company insist on charging me £30.They get really shirty when I question the charge but I cant really afford to pay it on top of a hefty monthly payment.:mad:

    Are they entitled to the full £30 or just £12 which the OFT ruled on re-credit card charges last year.

    can anyone help?

    Your clam is against Black Horse Finance as they have made the charges against your account with them. Nothing to do with the bank, although they may have also charged you at the same time for bouncing the Direct Debit or Standing Order (double whammy) :o

    CAPITAL ONE = £981 charges = £1,489.03 (152%)
    BARCLAYCARD = £580 charges = £786.12 (136%)

    A+L = £722 charges (target = 147%)
    BARCLAYS = £1,405 charges (target = 128%)
    BARCLAYS = £175 charges (target = 140%)
    ABBEY = £3,220 charges (target = 148%)

    They, as with credit cards, are entitled to a maximum of £2! Even the £12 is unlawful so don't be put off and take it to court ;)

    hi i was wondering if i could claim back my charges from blackhorse?? i have just finished paying my loan but i have paid over £600 in charges.

    Hi Becky,
    My son has just finished paying off his car in March, bought through Black Horse. He has charges on top off about £700 for a couple of late payments and returned D/Debits. Some of these were called collection charges and were over £100. How can they possibly justify this. I am going to be claiming them back on his behalf,

    im ready to take a car finance company to court to reclaim charges for late payments. £26 per charge.i have not got a copy of my T&Cs would you suggest asking the finance company for a copy before i do. Could this company justify their high charge by saying this is interest added for late payment.thank you Geoff

    Many thanks for your reply I really appreciate it.You mentioned that they can claim £2 per charge back and not £12.
    Didnt the OFT make a £12 standard charge on credit cards last year?
    I just want to clarify it as im unsure whether to go for £2 or £12.
    Im sick of finance companies and banks ripping everyone off and im also annoyed with the banks as you have to go to court to get charges back,its a disgrace.

    the oft £12 ruling was just a guidline, and the £2 charge is what it is more likely to be , ask them to supply you with a breakdown of their charges,guaranteed they wont supply you with this info. so do as everyone does claim back the whole amount

    The £12 is now used by the banks and credit companies as a justification to keep hold of your money! Capital One tried it on me but I refused ;) They have now offered 100% of charges ;)

    Don't be fobbed off and if you threaten court then take it to court in your time scale not theirs and add interest ;)

    Also as I was not able to find anyone else's decent wording on how to reject a partial offer I thought you all might like these words :)
