im ready to take a car finance company to court to reclaim charges for late payments. £26 per charge.i have not got a copy of my T&Cs would you suggest asking the finance company for a copy before i do. Could this company justify their high charge by saying this is interest added for late payment.thank you Geoff0

Hi all,
Not sure if this is the correct place to post, however I have just been charged £15 to change the date of a direct debit with Black Horse Finance.
I use them for my car finance (only a year left to go!), and have recently changed jobs..my new job has a pay date of the middle of the month rather than the end, hence the changing of the direct debit date.
This seems to me to be a very high charge for changing a date and I wondered if there was a way I could claim this charge back, as with bank charges? No other company has charged me for changing my direct debit dates.

Hi, has anyone been successful in claiming their car finance fees?
I have been charged £45 (made up from £30 admin fee and £15 request for direct debit fee).
It has only happened twice, but I feel that £45 is totally over the top - I have written to them twice saying their fees are unacceptable, and they say they are completely justified.
I argued about Unfair Terms, and they have said that the OFT rule only applied to credit cards, and that it does not apply to them?
My next step is to take them to court, but I feel a bit ridiculous over £90. Has anyone got any ideas, or success stories of how they managed to reclaim the charges?

I have recieved my statements today from Black Horse. They are charging me a £500 collection activity fee and £100 late payment fee Plus £93.70 late payment interest.
I thought this account was paid off and it wasnt until I saw a copy of my credit file that I realised I was down as still owing them £339.00.
I have asked them to remove the default on my credit file but they wont.
I have just spoken to a person in the collection department in Edinburgh :mad: (it was like talking to a human devoid of a brain cell) he says they are not subject to the same OFT guidelines and I cannot claim back any interest or charges and that basically when I signed the credit agreement I signed to say I accepted ANY charges they felt like adding!!!!!!
I will now send them a letter asking them to give me back my money.......will let you know how I get on.
Is there anyone else who is having difficulty with them.0 -
They wrote me a letter saying that too. I kept the statements but Im out of my depth as it is with all this. I really couldnt say whether theyre right about those guidlines or not0
