Shouldn't make a difference, they should be regulated by the Financial Services Authority if they provide credit. I would start a claim in the same way, other people have claimed on HP agreements.0 -

We did start this process last year, but stupidly lost track of when to write back to them. I think they offered to deduct some money if we paid the rest in full, but can't really remember.
I'd say go for it, especially if like us, they would not accept reduced payments due to my being unemployed0 -
do u think they will want me to settle the finance then before i get the charges back?0

Hi
Just a quick note we have been trying for 18 months to get charges back from a car loan, the car was re-posessed last april, the only money we owe is charges, they are now chasing us for over £4000, which is going up and up ever month, so if you get anywhere, let me know please, OnLine finance we were with, which have merged with GMAC our mortgage company ahhhhh....0 -
Hi,
My father-in-law has recently been taken to court for falling behind with the payments on a car finance (Capital Bank). I went through his account statement as he could not understand why he was behing with his payments. I discovered that the overdue sum was actually down to charges he had incurred for making payments late.
I wrote a letter and worked out the charges that had been applied to his account including interest. I used Martin's templates for claiming back bank charges with a few rewordings for this purpose. This was submitted as his defence into the court. As he was counter-suing for these charges this was adjourned. My father-in-law was told that this was because of what was happening with the bank charges test case and also that something similar was happening in Cardif with a finance company and these charges couldn't be claimed until this was finished.
Has anyone heard anything similar as I currently have 5 claims waiting to fire off for my partner to finance companies.
Thanks
Lou0
