    They told my partner on the phone that "we are not a bank, you can't claim from us" !
    I wrote to them threatening court action, and they have now offered a partial refund. Of course, i have written back saying that i want a full refund within 2 weeks or i WILL take them to court. I have told them that i will accept a lower figure (the actual fees etc but without the added interest) if they pay up within 2 weeks.
    This worked with Barclaycard, so fingers crossed....

    Don't give up, you will get there in the end if you persist!

    I will in December make a final payment on a 5 yr car loan I initially took through Black Horse finance, this transferred to Paragaon during the term. They have advise me I missed 5 DD payments (which I subsequently paid with debit card) for which I will be charged £25 each. Also, they have told me I have to pay an £85 "Option to purchase fee". Are either of these reclaimable? I thougth I was taking a general loan - not one that had "options" assigned?

  • My partner is being pestered by OnLine Finance regarding charges for letters 3 years ago about late payments.This despite the fact that he had been made redundant and had redundancy cover which covered the payments.On Line finance were made aware of this and all payments were made,albeit sometimes late due to delays in processing the payments on the part of the insurance company.OnLine ignored his letters and phone calls and continued to demand charges for their letters,and are still demanding charges.Can they do this?Can He reclaim charges as with banks and credit cards or do the rules not apply to finance companies.Thanks for any help/info.

    Its not a rule, its the law and it applies to EVERYONE..

    Are they purely demanding late payment charges? And how much are they?

    Dear Sir/Madam

    I am writing in response to recent correspondence requesting payment of £XX.XX late payment fees on my account.
    Please supply me with a full breakdown of the costs incurred by you as a result of these late payments including details of how you arrive at the sum you are asking me to pay.

    Please be aware that the law states that you may only recover costs incurred as a result of breach of contract terms. Any charges that exceed the amount of your liquidated losses will constitute contractual penalties which are unenforceable at common law.

    If you are unable to prove that the above charges reflect exactly the costs incurred by yourselves, I will not be prepared to consider any further requests.

    I would also like to make it clear that if you continue to pursue me for payment without satisfying my request, threaten legal action or refer this matter to a debt collection agency, I will consider that to be harrassment for which I will not hesitate to seek legal redress.

    I am in the same situation as many of you and although my agreement with my ca finance company will finish in Jan, I still have 1200 charges outstanding, does anyone know if i'll still be able to get rid of the car in jan or have to wait til charges paid?

    Can anyone advise me if Ican claim back charges (missed/late payments) against a loan that I had (Blackhorse ltd.)

    Thanks for any input (they have said that I wont be able to recover any charges as it is diffrent from banks?????

  • HELP WITH FURNITURE FINANCE

    Please help. I heard somewhere that if I was sold a credit agreement by a salesperson working for the store that sold me the furniture on 0% for one year, that it could be classed a miss-sold, does anyone know anything about this please.
