hello all
firstly slap me of im being greedy as im already claiming from the Abbey, Egg and Barcalycard, but I bought a car brand new with a Hire Purchase Agreement but because of redundancy I voluntary defaulted, this was back in 2005. Can I claim late patment fees cos for the last 3 months I really got battered with charges?
ps. the debt was satisfied after a couple of months, they wrote no debt off and were paid in full.
does anyone if i claim?0 -

I sent a letter asking that Black Horse reimburse the late payment fees etc and I have recieved a reply this morning saying that my claim has been regected due to them thinking the charges are fair and lawful......so is there anything I can do now ? Has anyone actually been sucessful with reclaiming from BH?0

I am not sure if this has already been covered somewhere else on here, so if it has, please accept my apologies.
I have my car finance through Capital Bank. On occasion my DD for the repayments has bounced...this has incurred a £34 charge from Alliance and Leicester.....but also a £25 charge from Capital Bank....thus I have then been charged by both parties....a grand total of £59....not to mention the £50 that A&L charge for day 1 and day 5 unauthorised overdraft....costing me £109 each time this happens...and it has been a fair few times now as I just can't seem to stop the cycle! (And CB also charged for letters that they sent me on top of this at £25! The amount just goes up and up! The repayment on the car is £189.84....by the time both of them have finished with me the car payments have almost doubled!!)
First up...is it legal to be charged by both parties, and secondly, can I reclaim the charges from Capital Bank for the car loan? (I will be trying to reclaim charges from A&L)

Its sounds like both parties are allowed to charge you, thou off course i believe the charges to be illegal anyway. Like you, I got car finance, im trying to get peugeot finance to provide me with the list of details.. but day 33 and seen nothing yet!0 -
Let's make an analogy! I throw a brick. It damages some property and then on the rebound it hits someone on the head. Do I then not expect that both victims will be entitled to something from me, for what I've done?
If I didn't expect, then I would not only be, as they say, "out to lunch", but the table would be on another planet. OP has broken terms with both parties and should pay up. Any disagreement as to amount is a separate issue.0 -

I have asked for a copy of my charges from Peugeot Finance, and awaiting them. I rang them up to chase them, I was told they were about to be posted and asked why I am asking for them. I said I wanted a copy for my records and 'keeping my options open!'. The gentleman then said that he hopes I wasn't hoping to claim as they are not a bank or credit card company but a different type of financial institution. He was very pleasant and courteous, and thoroughly convincing!!! Is he correct?
he also said that so far, no-one has sucessfully claimed from a finance house, other than a bank or credit card company?0 -
i just have my statements back this morning from my car finance company.
1) they have charged me £25 penalty charges (their wording!) can i claim these back.
2) when after 2 years i defaulted on the agreement, they charge me a £170 default charge? is this claimable?
this is very confusing, even at the end of the statements.. it says im £101 in credit!! did think this was possible on a hp agreement.

I have got in statements from a finance company (Paragon), that show the whole outstanding sum (£2480) is made up of charges.
I hadn't done anything about it for the last 6 weeks, and now they have filed to take me to court for this money.
Am I screwed, and should just bite the bullet, or does anyone know if there is something I can do.
Any advice appreciated.

Can I claim back arrears collection charges and repossession administration fee's as nothing was actually repossessed?
