  • just heard back from the Onbudsman today........not suprisingly Creative have been creative with the truth and BLATANTLY lied to him. as luck would have it my bank (Barclays god bless 'em) are well on my side with this and they have provided records to show creative are lying to the onbudsman. Happy days but where now?:mad:

    Just a quick update... FLA have replied and the company I am claiming against have now offered a good will gesture of £112 which has already been credited to my account. As the account is made up solely of charges I want the whole account writing off. Im really not sure what to do now, do I MCOL and can I MCOL? I would be greatful of any ideas or suggestions.

    That seemed like a very quick turnaround. Do you mind me asking who the store card was with?

    I've just submitted a complaint today to VLA regarding Creation Finance. I have another one sitting - GE Money which I'm deciding whether to send to the FOS or the FLA which is who GE say to send it to.

    Re Finance company fees you could do what i have done i contacted black horse and told them i was now in a position to start making inroads into clearing my arrears with all my creditors and that if they were to wipe all the late payment fees i would give them priority. Initially they refused until i said ok i will speak to my other creditors first as having my hard earned eaten up by charges is no incentive for me to clear that dept urgently. To my surprise it worked and they confirmed in writing that all charges had been waived, I also told them how much i was going to pay them not the other way round. I have done that with 3 creditors upto now all with success.

    Hi its with Barclays Partner finance (formally Clydesdale) I Think if they have suggested the FLA then that is the route you will need to take as I tried FOS first and was directed to the FLA. Let us know how you get on.
  • I have only bad experience to report with the FLA. (Finance & Leasing ASSOCIATION - not Authority).

    It is important to consider that the FLA are funded by their members.... the banks that you are claiming from. The 'Authorities' are funded by central government. I am not saying that the FLA are biased, but you should know where the hand that feeds them comes from!

    For me (claiming against GE), they have been less than useless! So bad in fact that I have now lodged a complaint against them with the FSA.

    You may be interested to know that the FLA now claim that they have recieved justification from GE to cover charges of £12. However, the FLA are refusing to provide me with a copy of the justification and are suggesting that I revert to court action in order to obtain the justification directly from GE!

    So, I have absolutely no idea what they have seen. But, I suspect that they have been pacified with GE telling them that they have reduced their charges to the £12 level mentioned by the OFT as being their action level.

    I have also been arguing about PPI with GE. The FLA have clearly taken GE's view on that and expect me to prove that I was mis-sold before they will do anything. This is despite me already demonstrating that the original application for credit was part completed by the shop assistant who indicated where I must sign (one of these places was for PPI).

    All the FLA have done is pass my correspondence to GE and forward their response to me. They have had no input into proceedings. Considering that I was at an impasse with GE before I contacted the FLA, this process has had a predictable outcome!

    I even had to remind the FLA of their Lending Code and referred specifically to where GE have broken it. The response I got from the FLA was that they needed evidence of a breach of the Lending Code and any action they took with GE would be internal and would, in any case, have no effect on my claim!

    This is a total contrast to the FOS, who have been slow but very supportive and have pursued the banks on my behalf.

    Not sure what to do next, but it looks like my only option is court.

    A friend of mine had a loan account with the title company from the purchase of some DFS furniture

    During which she missed some payments, incurred "Administration Charges" and received a Default notice on her credit file

    Is she able to reclaim said charges and also have the Default removed?

    I did similar with an old HFC loan a couple of years ago, but my appalling memory has failed to remember the letters and procedures required

  • Good morning all.

    Several years ago i had a Comet card which i believe is administered through Time Retail Finance.. Anyway fell into arrears and got passed through to a debt collection agaency...( Aktiv Kapital )

    Last month i cleared the balance and was looking to bin most of the paperwork with it. However i noticed i had several charges which were labelled as "Arrears letter charge" at £18 a throw.

    Am i able to claim those charges back....Bearing in mind they are not labelled as defalut charges...In all a total of about £180 worth of them...
