    I took out a HP Loan from black horse on the 25 march 05 for £429, I have got a letter at least every other month saying collection charge £30 as I am having trouble making the payments.

    Sent of for the statements and not 1 charge have they put on it, yet my balance after 2 years is £356:confused: Work that one out..

    And at the botthom it says charges £0.00

    Of course tried to ring them but cant get through.

    Any ideas?
  • I found a letter from several years ago advising me although the loan was now paid I had accured £500 in collection fees, I wrote to Black Horse via

    bearing in mind that the account was taken out in 1999 and so prior to the 6 yrs, I wasnt that hopeful , plus remembering how they were when chasing me for arrears !!!,:eek: however got a letter back today, saying all fair as per T&C however on this occassion a cheque was on its way for £262.:j I do recall their statements as being very vauge, maybe ask for a list of collection fees applied to the account so far.?

    while searching out my bank statements for the woolwich,I found a letter from Black Horse from five years ago to confirm my loan had been completed but there was £500 to pay in collection fees. I sent a letter requesting the refund of these fees, got a reply today, saying they were within T&C but on this ocassion blah blah a cheque is on its way for £262.53,

  • My wife has recently bought a new car which has been financed via a loan through Black Horse. We changed the reg no to a private reg and they now want £30 to change the number on the finance agreement.

    Any comments or suggestions please.

  • I have just successfully claimed £1730 from Halifax, but need to know if I can do the same for car loan default charges. I am concerned that they can take the car off me. I have read the terms and conditions of the loan and they read in exactly the same way as credit card charges. I have paid over one third of the loan so they cannot take the car off me without a court order but that it no comfort.

    Does Martin or Edinburghlass have anything to offer by way of help. I have noticed a couple of other posts on this subject but no replies!!

    I should think that you can. It would be up to the finance company to prove in court that their charges reflect the true costs of what theyre charging you for so the principle is the same as banks and credit cards and governed by Consumer Law. Good luck :)
  • Thanks. I have just done MCOL for £734 including court fee to Close Motor. I was one month in arrears and they were calling me a couple of weeks after the payment was due. Sometimes they left a message and I didn't speak to them until the evening when I got home. When I asked for statement of charges I discovered that they had charged me £10 for each phone call!. I recently rescheduled my due date and they charged me £30. I checked the small print of the loan agreement and sure enough there it was. Still a bloody rip off for someone who has only ever missed one payment. I'll let you know what happens.

    My OH would like to reclaim his charges from Direct Auto Finance, but I'm a bit unsure of how to edit the letter asking for the list of charges (given it's aimed at banks), does the following two paragaphs sound OK??

    I am writing to request a fully comprehensive list of all the default charges/late payment fees I have paid since my account opened.

    If you are unable to provide this data, I will accept a fully comprehensive statement itemizing all transactions; I understand that statement on its own is not covered by the Data Protection Act 1998, yet I’m not requesting the statement per se, but the charges, which I’m entitled to by law.


    Any other advice about claiming from this type of Company would be greatly appreciated.
