Finance Companies

  • The company is First Resonse Finance LTD. I have requested statement of charges from a car loan that we had and they sent me a list of charges but their is no explanation what they are for and they are all for £5 when I know that I have been charged more than that in the past. It says on the letter that they are charges without transactions.
Can anyone explain to a novice what they are on about.
  • Have a debt Management Plan which started in May 2004 and my Black Horse Finance car loan is almost payed off, at least it would be if they hadn't added close to £400 in Collection Activity Fees.
In some months they didn't contact me at all but still charged me.

Anyway, decided I would try to get this money back. Wrote on the 2nd of March, slightly adapting Martins Bank Charge letter template and received a full breakdown of fees by return of post.
Sent 2nd letter on 9th of March asking for this money back plus interest. Again slightly adapting one of Martins letter templates. I am hoping for a reply soon and will post here when I get one.

As it says in Martin's article:
The law is plain: any charges banks levy on their customers must be proportional to the actual costs they incur.

My thinking is that Finance companies are just a different arm of a bank. A bank without branches or should that be loads of branches that happen to be car showrooms or retail outlets.

    Hi All,
Had a bit of a problem with CNH Capital (New Holland Credit), wonder if anyone can help?
Basically my partner bought a tractor in 2003, for which he has to pay £117.50 a month for 10 months of the year, for the other 2 months the payment is £1796.72.
In November we had a bit of trouble getting the money to them on time, I telephoned at the beginning of the month to explain this and to ask if we could pay it over the next 3 months as thing were a bit tight. I was told that we could as long as we put in writting what we inteded to do, which I did straight away. By January we were left owing around £200 (including normal monthly payments), but with the late payment charges that were put on the account we owed £600. Then one night out of the blue at 9pm, we had a visitor "we're coming to collect your tractor in the morning unless you pay £1600."
Needless to say I was extremely annoyed by this. We explained that we didn't owe this much and we were given 2 weeks to try to find the money.
A week later the same bloke came again saying the tractor would be collected in the morning, we stuck by the arrangement that we would pay by the following week as agreed. We signed a letter stating this. I had a phone call the following morning, CNH wouldn't accept this and said we had to pay straight away. I had to hurry the application for a personal loan that I hyad arranged to pay this off, having to walk nearly 3 miles to the nearest bus stop to get to my branch (as I didn't have a car on that particular day).
I asked what the £1000 was for as we didn't owe this and I was told £750 was an arrears collection charge, and £235 was a repossession administration fee. Both of these I feel are exceptionally excessive as the tractor wasn't actually taken and we were trying to pay what was owed as quickly as [possible. Can I claim these charges back?
By the way I would seriously warn anyone off taking any finance with these as we have been told that they will do anything to get the traqctor baqck so that they can sell it on again and the original agreement was not what I should have been!!

im no expert but wouldnt have thought theres any difference as people are also claiming back on credit cards.
like everywhere all banks/credit card companies, etc do the standard letters saying your getting nothing back.
id file with the court and go for it - bet you dont get as far as an actually hearing!!! remember its your money and they took it illegally!!

Haven't had a reply from them so I am sending them an adapted version of Martins 3rd letter to threaten court action. So, hopefully they will reply within 14 days of this letter.
