Hi penny.pincher, Just seems like a delay tactic letter - work to your time scale 14days otherwise send the 2nd letter threatening court action.

    Hope this helps
    Good luck

  • Great, thank you! It has been 14 days since I sent the first letter... would I not send the second letter until another 14 days have passed, or send straight away as they have not offered to pay up?

    Thanks again!
If you think you can't or you think you can, either way you are right :D

If its been 14 days since you sent the first letter send the 2nd letter as set out in the timescales.

Hi if the 14days are up as you say on the 1st letter just carry on with the next letter regardless of what they say, this will give them a further 14days then if they still do not pay up which is most likely start your court claim - chances are they wont pay up until at least you have put in a claim via the courts.

    Hi jhchap9,

Once the 14 days are up on the 1st letter you sent (asking for charges to be refunded) proceed to the next step send the 2nd letter. PLEASE DONT WAIT FOR THEM!! STILL TO YOUR TIMESCALE OUTLINED IN THE LETTER YOU SENT ie 14 days.

    Good luck

Hi i've sen tthe first letter to abbey and they have sent what looks to be a standard letter saying it is a complaint, is there a template to send on to politely advise them that its not a complaint but a request for information?
  • i m in the process of claiming my bank charges back i have sent letter asking for my statments got them and sent copies of them back with charges highlighted asking for my charges back plus interest.but i have received 2 letters saying they are investigating my claim  should i send the court action letter or wait until they have finished their investigation  please can anyone help
  • hi, i think perhaps you should wait abit, are you claiming back the interest they charged you for unpaid dd or unauthouratised overdraft?? only coz thats situation i'm in too, don't know if i can claim the interest charges back, adds up to alot too??
  • I'm in the process of making my claim (thanks Martin) - and I'm at the point where I've send my letter with the figure (£3,122) and am awaiting their response.

I received a confirmation letter to say it will be 'considered' dated the 9th of May and today is the 14th day since my original claim.

When I called the number in the letter to see if there had been any consideration made to my claim, I was told it would 'take 8 weeks'.

My understanding of the procedure is this claim is within *my* time-frame, i.e. 14 days for a response before the 'Intent to Court' letter goes next, but the bank advisor told me that they would "adhere to FSA guidelines, go check the website".

So who's right? Can I proceed with the 'Court intent' letter yet, or do I have to wait for two months?
