I Put My Initial Letter In To Claim My Charges Back Due To Financial Hardship On 31/5/08.
(had To Leave Work Due To Suffering 2 Heart Attacks)
Halifax Sent Me A Letter Dated 17/6/08 Asking For A List Of All My Outgoings And Incomings.
Did This The Same Day And Returned It The Same Day"recorded Delivery".
I Rang Them Last Week To See How My Claim Was Progressing And They Said My Claim Was On Hold As I Did Not Mention I Am Having Finacial Difficulties.
I Know I Did, I Still Have A Copy Of The Initial Letter!!
So 8 Weeks Have Now Passed And Still No Reply...10 Weeks If It Starts From My Initial Letter.
Does This Mean I Have Won By Default??
Any Advice Would Be Greatly Appreciated!!0 -

If you have proof of this letter then they should continue the request as hardship. I have an email address for the Exec Office and received a response from them, if you want it PM me as I don't think you can give it out on the forum.0 -

I would send it as a continuation of your first complaint, mainly due to the Limitations. You may have a reference number from that that you can add to your letter so they can find your previous complaint.0 -

the halifax overdraft system changed at the start of the year so that only Head Office Arrears department could put temporary overdrafts on account that would get replaced by the previous one.
If your overdraft request was actioned in a branch or over the phone at 24hr banking then they would have ust put a new overdraft on the account for a limitted time.
When this time expired there would have been no overdraft to replace it. (all overdrafts in HBOS have a expiry date of between 1month and 1year)
If your overdraft was administered in branch then it probably was a staff error and you should speak to that person directly.
Ideally it would have been done by a telephone agent in Belfast (the only one in Ireland so if they had an Irish accent it will be at Belfast contact centre). They record each and every call through that contact centre. If they had a leeds accent then it was arrears and they should have put replacemt overdraft on account. If scottish accent then they dont tend to record many calls.
the system would show the initials of who keyed your overdraft as well as location code regardless of where it was done
Basically, after rambling on, you are not at fault and there should be a way to prove it. As i said, ideally you spoke to Belfast, ask for a transcript of the call.
Reject customer relations response and demand further investigation as you were specifically told it would happen.

I apologise if you've read this before, but I haven't had any replies so thought I'd try again. I really would appreciate any advice on this.
I tried to claim back over £1600 in charges from HBOS last year. In July, I received a letter stating that they had put £888 into my account, but that this would be in full and final settlement. If I wanted to accept, to do nothing, but if I wanted to reject the offer, I should return the money and await the outcome of the court case. As there was a lot going on in my life at that time, I did nothing, and since then, have spent the £888. Does this now mean that I cannot pursue HBOS for the remaining half of my claim (plus further charges since then)?
Any advice gratefully received.0 -
You could claim charges that werent included in your original claim but I would have thought that because you accepted their £888 that claim is now settled.£10 per day Challenge (Oct)
