    Is this the letter requesting statements, or the letter asking for charges to be refunded?

    requesting statements/charge list. was told they only issue statements not charge lists though!!

    Hi,

    You don't actually need the list of charges to reclaim. Did you keep your statements for the past 6 years. If so miss this step and use them to make your claim. Just remember to photocopy them and don't send the originals.

    Hi folks,
    I am a newbie on this forum and I have read the last 10 pages to try and avoid postings similar to those already sent.

    I have two accounts with Halifax, A Current account (debit card only) which I use for everyday use and pay Standing Orders and DDs. I also have a Cardcash account which I use purely for internet payments and keep the balance very low and only transfer as much as necessary from my Current account to provide extra security.

    I originally had only my Cardcash account which I used for everything. When I was working, I always got work through agencies so, consequently, I was often without work especially around the winter months unless the contract I was on was for a long term. Last year I went to work in Afghanistan for a while so opened a joint Current account with my sister in order that she could access my funds if anything needed to be paid whilst I was out of the country.

    I have managed in the past year to keep my Current account out of trouble but previously when using the Cardcash account, I was frequently getting bank charges and they ALWAYS refused payment

    I have tried in the past year to not use any of the agreed overdraft (£100) on the Current account but I recently had to give up work due to illness. It took over 10 weeks before I received any pension credits payment so I am afraid that I had to use most of my overdraft. I had previously stopped all SOs and DDs but I forgot two regular payments that were drawn on my debit card rather than directly from my Current account.

    Although, historically, the bank had always refused payments over my fund limit this time they paid the two items which caused my agreed overdraft to be exceeded. They then charged me £35 each for the two items and a further penalty of £28.

    Forgive the length of the preamble, but I now get to the points that I would appreciate answers on.

    1.I understand that the recent ruling found in the bank’s favour concerning that charges were not ‘penalty’ charges. Yet, I had already paid £70 in charges so what is the £28 charge for if it is not a penalty charge?

    2.Secondly, Halifax have always in the past refused payment but chose to do so on this occasion. Does this not amount to the bank agreeing to extend my overdraft and therefore, should not be charging anything apart from agreed overdraft interest rates?

    I apologise for the length of this post but hope that someone will be able to answer my queries.

  • Hi,

    I decided to claim Credit Card charges back from Halifax and am now in a battle of wills with Halifax and was hoping I could get a few opinions on what to do now.

    Basically, the charges amount to an unworldchanging total of £121. An offer was recevied from HBOS for this amount.
    As I have not used this account for several years, I phoned and asked if it was possible to receive this as a cheque rather than what the letter stated, that the amount would be paid to my account. I was told it was possible and to amend the acceptance letter accordingly and to return it.

    As I hadn't heard anything for nearly two weeks, I decided to give them a ring and find out what was going on. Now according to the HBOS customer relations department (that has got to be an oxymoron), because I asked the payment to be made by cheque, that constitutes a non-acceptance of the offer, because apparently, there is still a debt outstanding on my card.
    Well the truth is, there was a debt outstanding, but 4 years ago I had to take out an IVA due to a really horrible moment in life when my wife was severely ill. But the debt that was owed on the credit card (according to my annual IVA statement) has been sold to a company by the name of Max Recovery Ltd.

    So I phoned HBOS back today to point this out and to inform them that they were witholding the payment under a false pretence and was told whether that is the case or not, under the Financial Ombudsman guidelines, they still have until mid-september to relook at my 'complaint' and give me a response. I said that there wasn't a great deal to be investigated, but no matter what I said, Including saying as a matter of principle, I would now pursue the money through the small claims court and potentially end up with a payment of the original £121, plus interest, plus they would have to pay the costs if it was found in my favour. At this point, the person i was speaking to turned into a scratched record and kepting stating that 'the complaint was being looked at in accordance with the companies...blah blah'.

    Now, out of sheer pure-bloddymindedness, I am tempted to follow through with that threat. The options open to me are:

    1. Sit and wait it out to see if there is another delaying tactic.
    or
    2. File a small-claims case.

    At the end of the day, will there be much difference in time scale. What would you do?

    Thanks for any advice anyone can offer.

    And as an addendum, as several of my debts seem to have been sold to Max Recovery Ltd, should I be contacting Experian and the like, to have my files adjusted, or would it serve no purpose.

    i dont know about halifax specifically but most credit cards pay up in full as soon as mcol has been started. So in time scale about a month from starting small claim.

  • Hi, i'm hoping someone can advise me as to what i should do, i see many people talking still about reclaiming their charges and it makes me curious as to why i was declined mine. I initially wrote to my bank (bank of scotland) in july last year asking for my charges back, the reply i got is as follows.(i have cut the boring bits out):

    "i have carried out an investigation of your complaint and i am satisfied that the charges have been correctly applied to your account."
    it then explains why i have been charged and how they can help me.

    "Outcome - i am sorry to advise that i am declining your complaint, i hope i have explained the reasons for my decision".


    Am i able to reapply? if so will i have to go back 5 years(in scotland) from the date of my new letter?
    Have i left it too long since my letter of reply to do anything?

    Grateful for any advice :confused:
