I recently wrote to the Halifax requesting refund of £56 unauthorised overdraft charges. Got a reply yesterday stating that the compliant is on hold pending the ongoing test case, which is fair enough.

However, I have also received notification of two further unauthorised O/D charges that they intend to apply, the first of which will be on 30 June. I don't understand why they plan to do this as the a/c is now in credit - possibly because it was still overdrawn on a specific day on which the charges were triggered.

Anyway, I obviously don't want to pay these additional charges so plan to close the account before June 30. My question is, would this action adversely affect my chances of getting the charges refunded?

    Thanks for any advice.

Hmmm. Done a bit of Googling and think I've found the answer. From what others have said, it seems likely that the bank won't close the account until any pending charges have been paid. So I might as well pay the extra charges when they kick in, and just add them to the list of charges I'm asking them to refund. No advantage in closing the account in this scenario.

    Hi,

I'm new to the forums and whilst browsing thought i'd relay my dillema to the forum in hope that someone may be able to give me some guidance.

I don't know if anyone has had any success with Halifax. But i have had two outstanding claims from Halifax since August 2007. I recieved initial letters that they would keep me posted on the progress, but i've not heard anything since!

More recently i got married. With my head all over the place i accidently paid my venue from my current account card (Halifax) instead of the wedding account i had opened. This resulted in me being overdrawn and then paying a total of £238 charges in a week!! Only finding this out when i return from my honeymoon, with no warnings!

Can anyone please advise on how i can get my money back? As although the relaims seems to be on hold during the test case theres a number of you that have succeeded.

Although not in hardship i could really do with the amost £2000 refund.

    Thank you

If you aren't in hardship they won't refund until the conclusion of the OFT test case. If you still have the paperwork then write to them and explain the situation and add the charges to your existing one.

  • I'm hoping someone will be able to answer this one for me. I have an Halifax account that I did not have an overdraft limit on it. By mistake my account went over drawn because Halifax didn't stop a payment and a cheque going through. I thought if you didn't have an overdraft they had to refuse cheques or debits? Because of this I incurred £133 in charges. Can I reclaim these?

Yesterday the same thing has happened (I now have an overdraft arranged). They let my account go £2.52 past my arranged overdraft so I'm expecting more charges probably just under £40 for £2.52.

If I sent the unlawfully deprived letter template from this site will I get these charges back and also will they tell me I can't have my overdraft any more because of this claim?

    Hope you can help

  • I turned down Halifax's original offer - stupidly in hindsight and then the courts overturned the case against them before Christmas. Where do I start now?

The MSE guides to reclaiming is one place for starters.

Hi. I am new to the board and don't know if anyone has posted about the new HBOS charges, being £1 a day if you are under £2500 over draft and £2 per day if over that and then £5 a day if you are over your arranged overdraft.

Well this is why I am here, I don't know if I can claim that back? is this possible?
I had to deal with them last year with charges and they paid as I proved financial hardship. I am sending them a letter tomorrow to get any statements that I haven't claimed back, which I can see being well in excess of £200. I know that doesn't sound like much, but when you are a student, it's a lot.

Could someone tell me if this is possible? or even point me in the direction of the discussion if there is one already going on.

    Thanks.
