sent my hardship letter to the bank in march(i'm with the halifax, got bank charges totalling just short of £6000) got a standard reply back in may!! saying they not dealing with any claims due to waiver blah blahblah, but if i filled out the enclosed financial statement and sent proof of my financial difficulties they would then review my case, have done that on 18th june and am still waiting for the outcome of their review, if its another knock back my next move is to go to the fos. prob be doing this next monday if i not heard back from halifax.

    Do y
ou have a template for this hardship letter....?

What do you mean you, 'filled out the enclosed financial statement' ...?

  • Im in the same boat, but with the Royal Bank of Scotland (Part of Halifax).I went overdrawn by £6 even though my online banking doesnt show a negative balance. They are now charging me £63 for the privilige  which is £35 charge plus £28 unauthorised overdraft fee.
I am very angry that they can seem to get away with extortionate charges like this.
I would also appreciate any help.

    Thanks

Bank of Scotland is the same company as Halifax, not Royal Bank of Scotland :) Just as an FYI.

Royal Bank of Scotland group owns Natwest too.

i have gone over my overdraft by £2.41 and im getting charged £35 and £28 im currently on income support, i have rang my bank & they said there is nothing they can do as i have already had a charge reversed a couple of months, is there anything i can do or do i have to pay it??
i only get £150 a week and they wont even let me pay it by installments oh my god

    please help me

    thanks

If you're on benefits as your support you can reclaim the charges and the bank have to follow the FSA waiver, meaning that you don't need to wait until the test case is complete.

ie. Put in the reclaim letters as on this site but modify it including the above information mentioned by Sol00. They have to look at your claim as you are experiencing 'hardship' and the income support you receive should compound that. If you need help, visit your local CAB.

    Good Luck

Geeez that's abit harsh, I've just agreed to an £500 OD with Halifax and I dont intend on using it either. Reading this thread made me look at other banks, I then opened a Premier Acc with Allience & Leicester, if you become over drawn on your OD you are not charged for the first 12 months, but after the year, if i read this correctly you are charged 50p a day for using your OD, but still would not occur charges if you became over drawn.

My 19 year old son has been charged:mad:  since January £304 in overdraft charges and what the natwest calls ' a referral fee'. He has been charged this fee 3 times. We asked the natwest to refund these charges but they refused. I have now contacted the financial ombudsman, as I fell he has been robbed. He only earns £80 a week and feel there is no recourse to hit back. Does anyone think we will have any luck with the ombudsman or are we wasting our time here ?

Unless he incurred some of the charges before he 'came of age', then you're wasting your time.

He'll have to file a claim with the bank, join the queue, and hope the banks lose in court.

Just out of interest, has he (or have you) analysed the situation and understood how he incurred the charges in the first place?

I think the 'referral' fee is where they honour a payment but charge you £30 for the privilege.

    Is you son a student?
