we claimed june last year i think we had a letter telling us to wait till after the test case but last week we got an offer but they said that it would be taken off the balance of any overdraft or credit cards we have with halifax0

Sounds like a condition of the offer, so it's up to you if you want to accept it. Certainly, most financial institutions will make links if you have more than one account with them - if they're chasing debt on a credit card, they can raid your savings account, for example.
Is it a problem to you? Would you be happy knowing that your credit card balance has been reduced? You may not be able to get a better offer from them (they've likely only made it to help balance off their bad debt book)...Mortgage | £145,000Unsecured Debt | [strike]£7,000[/strike] £0 Lodgers | |0 -
hi i have phoned the bank on several times asking them to stop charges on my account because i am on benefits and also could i have a list of all charges on my account since i opened it 2 years ago. they said to me to send 10 pound to them.my boyfriend was looking up laws around benefits and come across the socail security administration act 1992 chapter 5.section187 certain benefit to be inalienable subject to provisions of this act, every assignment of or charge on benefits defined in section 122 of the contributions and benefits act , any income-related benefit or child benefit and every agreement to assign or charge such benefit shall be void; and , on the bankruptcy of a beneficiary, such benefit shall not pass to any trustee or other person acting on behalf of his creditors. i imformed the bank and they said no such law exisited so i put in a complaint and they finally said they will do a finanical hardship claim for me today. i asked would i get my charges back and she would not answer. hopefully i will recieve the forms soon. they told me it will take 5 days. hopefully they live up to there word.0

Yup that happened to me, and when I went to speak to someone at the bank just asking what were these. The manager was very rude and aggressive and said we will not refund you, I told her I did not even ask for refund I went explanation but she was very rude, she boiled my blood so guess what?? I am going to try to claim all that now. £35 for each payment that was outrages and there is a charge of £70 at one point!!0

I have just recieved confirmation from the Halifax (HBOS) regarding my case in the 'unfair' charges fiasco. It reads as follows:
''HBOS believes that unarranged overdraft charges are fair, they reflect the service customers enjoy and that legal certainty over unarranged overdraft charges is in the interests of all concerned.''
i for one DO NOT enjoy the service of the Halifax charging me over the top prices for a computer printing out a standard letter as soon as my account goes overdrawn by a few pennies. I mean £35 ? and that charge is certainly not in my interest is it? A piece of paper costs at max 2p a sheet, the program the computer uses ,ok had to be developed but the Bank offset that against taking it out of the interest they are supposed to pay you. I think that we , as the 'paying' public should do the same to the bank's.
I think next time I recieve a flyer for a loan or a mortgage from a bank, send it back with a notice saying that if I continue to recieve 'unwanted' post such as these then I am within my rights to charge them for the time of me recieving the letter, opening the letter and reading the contents , as it is a waste of my time.
The only post I WANT from my bank is my statement ( which I get online anyway) or notice of any changes to my account.
I think a nice round figure based on the same calculations that bank has made when deciding the amount to charge so the amount I would charge is going to be (stab in the dark, figure plucked out of middair then doubled) about £300. Sounds 'Fair' don't you think?.0 -

What does your letter say?0 -
I received a letter. It's basically just saying that nothing will change until the appeal hearing and that all cases will still be held.
I am a student and asked they hurried mine through due to the FSA waiver re this. They've said they see no reason as to why and sent me an Income and Expenditure form! :mad:0
