Nobody is giving her a hard time.aggypanthus wrote: »Why are you all giving this girl a hard time?
If I were asked, why didnt you see the car, it would put my back up too- there cant be an easy answer to that, or the accident would have been avoided. If we had a special all seeing awarenss 100% of our lives, accidents would never happen.
and I bet the driver would say, I just didnt see her , I dont know why!
To those who slag of ambulance chasers, dont forget the real experts who fight for large life enabling awards in the aftermath of spinal injuries and brain damage caused by road and industrial accidents.
Just stating that no award will be made unless the driver can be found to have been at fault. So far the only "evidence" of this has been an assertion that it is always the drivers fault. Which is just plain mistaken.0 -

Suggest Maestro and the OP actually read the Highway Code (which isn't actually the LAW anyway)
https://www.gov.uk/rules-pedestrians-1-to-35/general-guidance-1-to-6
From your link:
"8
At a junction. When crossing the road, look out for traffic turning into the road, especially from behind you. If you have started crossing and traffic wants to turn into the road, you have priority and they should give way (see Rule 170)."
And rule 170 states:
"170
Take extra care at junctions. You should- watch out for cyclists, motorcyclists, powered wheelchairs/mobility scooters and pedestrians as they are not always easy to see. Be aware that they may not have seen or heard you if you are approaching from behind
- watch out for pedestrians crossing a road into which you are turning. If they have started to cross they have priority, so give way"
Whether or not the highway code is "the law" it will be taken into great consideration. Reversing up the road at the speed limit is not against the law either, but would most likely come under reckless driving and endangering others to name just two. As would going up a motorway at 70 in a blizzard.Oh, you wee bazza!0 -
No mention of any junction by the OP.From your link:

If she had said the car came flying round a corner and hit her, that may have been different.0 -
The accident happened on the main road, there is a junction about 100 yards away from where I was crossing where the car might have come from, but I didn't see it so I don't know sorry.0
