I had just under £3.6k locked for 6 months in January. Now I have to accept payments in a friends name....you won't believe how much trouble I was in to repay my suppliers in January when my paypal funds were locked!

Paypal should seriously be dealt with....maybe BBC watchdog is a viable option....anyone know the likelihood of the story being picked up? Seems like there's quite a few of us with this problem.....maybe Martin could help us hook us up with someone at the BBC since he regualry does interviews for them?
  • Terrible news and another excellent example of why I don't accept Paypal.

I certainly wouldn't stand for any of this and would have been down at my solicitor's office by now getting a court summons sorted out.

    Do it.

Most likely your verified PayPal account has been limited for several factors. You don't have a well-established history of selling the same kind of items, and some of them are in a high-risk category namely consumer electronics. Items such as Xbox 360 and mobile phones are deemed highly likely to be subject to a PayPal dispute or credit card chargeback within 180 days. Therefore PayPal has limited your account to protect PayPal against any potential losses.

The thing is the OP has provided them with all the information they need to prove who she is and where the items have gone. What else do they need - blood? Besides, you can only do a charge back for 45 days - they are talking crap and this is well beyond a joke to be honest. I have said what I would so and would definately do it. Once one person does it and wins then people will know they can follow suit and Paypal will gain themselves the reputation they deserve. There is no way they can fight this in court, it is absolute rubbish - where can they draw the line? They can close every account tomorrow from someone wo has sold something expensive incase of 'trouble in 6 months time'. I think the OP should also call trading standards and inform them as they might be able to put some more light on the subject.

To be honest, i do not think Paypal will; care but I'd give them 14 days to repay you and CC the letters to the MD and anyone else you think is relevant. It's about time us ordinary people stood up for ourslves against this kind of 'open theft' of our money!! They have your money and won't give it back - surely that is what it is? Theft!

Ooh, this thread made me so angry, sorry. Always the 'ordinary' peson, the scammer get away with screwing people blind while the people selling because they need the money have theirs taken away.

I don't think the OP needs a lecture on not buying expenive stuff though and she had already said she sold stuff that she did not want to - she obviosuly is short of cash and sold things so that she could afford to live so would not be able to afford tem now anyway. Situations change - a year ago they may of been able to afford spmething nice but a year the situation could of changed and they have to sell it to get some money in. That is life and stuff happens - she should not be penalised for trying to get by. if the stuf she has sold is 2nd hand then where is the problem? Surely people are able to sell their possessions without having the money they earnt from it stolen by Paypal.

    Dear sir or madam

My PayPal account name / details / number etc

Further to my recent conversation with your customer service centre, I would like to raise some concerns over your recent actions.

I am a long time PayPal customer and have never had any reason to complain about your service, nor have you had any reason to call into question my integrity.

My understanding is you have closed my account due to what your office has called ‘xxxxxxxx’. I am most unhappy about this course of action as this has forced me to cancel some current ebay listings. In addition to this you are holding x pounds of my money for reasons that are unclear to me.

I would ask you to review my account and reopen my account for my use at your earliest convienance. Should you find this course of action unavailable to you, I would ask that you put into writing your reasons for freezing my account.

Your response is requested in writing, within fourteen days. I will be taking legal advice if I do not hear from you within this timeframe.

    Yours faithfully

    S. xxxxxn

This is paypal's auomated response to these scenarios:

    Dear ****,

Thank you for contacting PayPal in relation to the limitation on your
account, my name is ******* and I am happy to assist you further.

We have reviewed your account and it shows that PayPal are holding funds
on your behalf. Regrettably it is a necessity that these funds be held
for a minimum period of 180 days; however I am happy to explain the
    reasoning behind this hold.

As you are already aware, PayPal is a financial institute and as such
there are certain risks that, as a business, we need to make sure are
minimised for the benefits of both the business and all PayPal
customers. I would like to add that we have no intention of retaining
these funds for any period of time longer than the necessary 180 days.

Some of the risks that your PayPal account holds for PayPal are the risk
of chargebacks and Buyer Claims. These risks cannot be foreseen and thus
PayPal must take protective measures to avoid any loss to PayPal. As you
may already be aware, the timeframe that credit card companies allow for
chargebacks to be issued is 180 days after the initial transaction. It
is this 180 days that PayPal have based our policy around. If we were to
allow for all the funds to be removed from your account and a chargeback
was issued, PayPal would, by law, have to pay this chargeback from our
own account. As you can imagine, this would potentially open up PayPal
systems to abuse from unscrupulous individuals. We are not in a position
whereby we could make a judgement call on each case and it is imperative
that to PayPal that we treat every account equally. As such we have
written into our user agreement that if any situation arises where
PayPal would prefer to end our business partnership, we have the right
to protect ourselves against any risks.

As we make a point of treating each customer equally, it is with regret
that we will not be able to remove this limitation until the 180 day
threshold has expired. Once this has expired PayPal will contact you in
order that we may return your funds to you as quickly as possible.

After reviewing your PayPal account, we have determined there to be
excessive risk involved and we would like to begin parting ways in a
manner that is least disruptive to your business.

If your PayPal account balance is zero, and you have no outstanding
issues, such as unresolved Buyer Complaints or chargebacks, your account
    will remain limited.

If there are funds in your account, the remaining account balance will
be held for a period of 180 days in order to minimise chargeback risks.
Any Buyer Complaints or chargebacks received against your account during
this time will be paid from your account balance. Once the 180-day
period has elapsed, you may either withdraw to a bank account that is
registered on your PayPal account, or request a wire transfer which will
    cost 40.00 USD fee.

If there are outstanding Buyer Complaints or chargebacks, and you choose
to refund your customers, please log into your account and respond to
each Buyer Complaint or chargeback in order to resolve each issue.

I realise that this is not the outcome you would have wished for and I
know it may not meet with your approval but I do hope you will
understand that this decision was made in accordance with our company
policy. While I cannot change this I will make sure you objection is
duly recorded. PayPal have abided by its User Agreement and polices and
have conformed with all associated laws to the best of our ability and
will obviously continue to do so. Unfortunately, at this time you will
not be able to continue to use the PayPal system for your business
purposes. We at PayPal wish you good fortune in your business
endeavours. I would also like to take this opportunity to thank you for
your co-operation with our ongoing investigation and regret that we were
not able to come to a workable solution.

    Thank you for your time.

Please let me know if you need further assistance.

    Sincerely,
    ****

i think you should also mention that you provided proof of delivery for the items sold and that you have received positive feedback and that you have done everything paypal asked you to do

So should i email it as well to the people higher up, that 'dustykitten' found the contacts for?

I will send it registered on Monday, and will include the bits suggested about people having already left feedback, and that they could track the transactions themselves with the info i provided.

I am not very hopeful though.

I wouldn't have a clue what to put on a moneyclaim form, i would assume i'd need to include some legal info which i don't know.

I guess the CAB coiuld be an option? Never had much luck there personally.

Well appart from phonecalls and letters i am unsure what to do.

Thank you all for your comments.

Hopefully you will folloe how i get on. At least i know what their initial response will be!
