I'm as big a gamer as they get, but honestly I couldn't care less so long as the game is brand new & in full working order if it was shrink wrapped - in the course of many years in games retail I've taken enough of that off the cases for it to have lost it's appeal some time ago!
You may say it's gross misconduct, but I know for a FACT it happens in a couple of GAME stores near me. How do I know? Cos I know the chaps that work there.
You know what else they do (under managers instruction) - Inspect any trade-ins for quality and sell them as new if the DLC codes still work (there's a way to test them on 360 without redeeming them, pretty sure the same is true for PS3).
Oh, and if the codes are still in-case, but the game is otherwise grubby? They take them, divvy them up and sell them on ebay. All true. Ever wonder where some ebay sellers get so many codes? Wonder no more.
And what's to stop these stores using "display cases"? They exist, I've seen thousands of them. Retailers of sufficient size should have absolutely no issue negotiating some display dummies from any publisher.
So, don't preach to me some tosh about it all being the same to you. I don't WANT fingerprints on my manuals/discs, I don't even want them on the case. Yes, it's anal, but it's my right when I buy a NEW game.

You really are anal, but I will point you to the fact you know this goes on, what have you done about it? I'm not preaching tosh at you, I've worked in games retail 8 years now, so when I see things like "retailers should be able to negotiate" it just makes me giggle. When was the last time you worked with a games supplier or publisher to spend money on providing us with display sleeves? That costs MONEY, all of which will be added onto the cost at source of the game, which will then be passed onto the consumer or absorbed by the retailer - which I'm guessing will annoy you greatly.
All of what you described above IS gross misconduct, but companies can only do something about it if it's reported, but a lot of it also sounds like tinfoil hat stuff as well - because over 3 regular stores in those 8 years I've never once seen anything approaching that. (nor did I see it in any of the stores I was asked to work in on random occasions)

It would be a VERY small proportion as the vast majority of customers (I'd go as far as to say 99.9%) don't walk around with their head up their behind. Also you're somewhat blinded by what is a very simple linguistic device - "new/sealed" can mean one of two things, that it is new AND sealed or new OR sealed. Don't patronise me because I happened to work in retail, without people like me you're likely to have to go online for everything which, oops, wasn't that my suggestion?

This thread took off a bit!!!!
Tesco are slipping up since I have had no email contact from them at all today.
Another point is that while the unwrapped box is on the shelf it can get scuffed, dropped on the floor, cracked etc and so does not look new. If you want to play and resell then that has to put you at a bit of a disadvantage.
Plus no one has commented on the fact that you can get a refund on a sealed game after Christmas (in the case of a duplicated purchase etc) but if it was bought unsealed then you can't prove you haven't played it so presumably you wouldn't be able to get a refund.
Point is I'm only talking about new games that I want on release day. If I'm paying full price for a game I don't want it delivered two days late by Amazon (Skrim anyone!!) I want it on launch day so I'm going to a shop.
I think I'm going to email Asda and ask what they do with their games.Don't grow up. Its a trap!

Anyway, we're digressing. Honeydog makes another valid point about the display case getting mishandled, dropped and pawed by grubby toddlers. None of which equate to new.
Still, you won't ever admit you're wrong (and I'm willing to bet you work for GAME, HMV etc who perform this shoddy practice) and as such cannot see past your paymasters' methods. I wonder how you'd feel if the next time you went to Tesco to buy a bottle of vodka, you had to take an empty bottle to the checkout and they poured it back into the bottle after you'd purchased it. :rotfl:
