    few questions please

    im starting the MCOL

the sample letter (with the 1080 characters part) its including interest, should i leave this in even though i didnt claim interest throughout the claim?

also the amount i am claiming, £366 (charges) + £30 (court fees), do i deduct the £88 they refunded me earlier and put in £278 + £30? (i'd assume it would be £278 but i just want to make sure)

    thanks :)

Definitely claim interest, you are entitled now that you are filing a court claim!!
    Reclaimed thanks to this site:

Can anyone tell me how long Capital One take to reply to the first letter stating the amount you are reclaiming. I have just sent the letter back recorded. Is it usual for them to put up a fight? ANy advice appreciated.

I sent my first letter reclaiming fees 2 weeks ago, and got a letter today offering me a small refund today, saying

"....as a matter of goodwill, I'd like to reduce the fees we've added to your account to £12 each" and gone on to explain they've sent me a cheque for the pittance they reckon they owe me.

I'm planning to write back and say that I will only accept this offer as 'partial settlement without prejudice' and that I intend to continue to court to reclaim the remainder unless they make a full settlement of my claim within the next 7 or 14 days (haven't decided which, as yet!)

    Hope that helps,
    Pam
  • Hi all,

I am going through both my wifes and my own Capital one statements and notice there's a difference in our annual fee charges where her's is £29 and mine is £9.

Anyone know why this is the case?:confused:

    thanx...

Perhaps your Credit limit is set differantly hence a diferance in price, or if you both got your cards at differant times then perhaps the terms/conditions are differant.

Either way it means your wife can claim back slighty more! :rotfl:

Thanks frugalpm. Keep me updated on the Natwest too. I have only just sent off my letter asking for my list of charges, so early days for me yet! It does seem from reading the sites that the banks, whilst having a standard procedure to follow, sometimes there is the odd quick settlement.I'm not that lucky.

    You're welcome :)
I think Capital One's letter to me was a bog standard response, and I'm sure they'll back down and give me a full refund once I show them I mean business - I'll take it to court if necessary, even though it's only for a few hundred pounds (I say 'only' but actually it'd be great help to me to get it back)
When I wrote to them, I stated that I only wanted payment by cheque (was lucky to be able to clear my credit card balance recently, and don't plan to use the card again, especially since they've hiked up the interest rate)

Look forward to hearing how you get on,

    Pam
