Absolutely, stick to the process, send a letter saying thanks for the part payment however you will be proceeding through the courts for the full amount if not settled within 14 days. If you don't hear file MCOL and they pay up! I have just successfully claimed over 1000 when they offered me 280!!

I've recently written letters to Capital One, Monument and Halifax Visa using the bank letters and adapting it accordingly.
Your letter of success with Capital One has inspired me, wish I'd given them a shorter time scale to respond, as I did state at the end of my letter as in the 1st bank letter." I look forward to your response within 40 days, as Capital One is obliged to reply under the Data Protection Act......"
My letters only went out on 17th April so probably won't here from them until mid-May.
I successfully claimed from Halifax Bank last August, (not full amount), £1,000 from a balance of £1,662 so have now written to them again asking for the interest on the £1,662. They have already acknowledged my letter within 3 days.
Are the Credit Card Companies very difficult to deal with?
Should I use the 2nd template letter used for the Banks if I don't hear from them within the timeframe?

I am in the process of claiming my bank charges back, which have totalled £397.
I am at the stage where I have now threatened court action to which they have replied:
Thank you for taking the time to write to us about the fees added to your account. I understand you think these are unlawful and I’m sorry you feel we've treated you unfairly.
To explain, we automatically add late payment fees if your payment is missed, arrives late or isn't enough to cover minimum payment.
When you opened your account in May 2004, we sent you a credit card agreement which stated these fees. By signing and returning this to us, you agreed to terms and conditions for the account including fees.
As you're probably aware the OFT, haven't challenged the right of banks to charge default fees, but merely the level of those fees. Although we feel £20 is a just fee, we've reduced our fees to £12 pound so that we're in line with our competitors. I appreciate that you've incurred previous fees at a higher rate, and would like to address this.
I've reviewed your account and, as a matter of good will, I’d like to reduce your fees we've added to your account to £12 each. I've refunded £136 and you'll see this on your next statement.
They have refunded the £136 on my credit card I don’t have anymore the account is clear!
Are they just trying to fob me off still? Do I now proceed to court in order to claim the £397?
Any advice would be much appreciated.

I telephoned Cap One on 4th April requesting my old account number so I could request statements via SAR letter. She told me she could do it there and then for me but it would take up to 21 days. 17 days later all the info I needed was on my doorstep. Woolwich also v. quick (about 3 weeks). Now the Abbey.......0

They refunded me £220, no questions asked. That was about 4months ago, I would call them and say you will accept it as a part payment, but hold out for the rest. If not, submit your court claim.0

if your account is clear then it will noe be in credit so why don't you ring them close the acc and they should then send a chq?0

Is there anyone who can suggest what to do next?
I have been claiming £1800 in charges from Capital One, i was getting frustrated at not hearing from them, and low and behold i received a settlement letter from them in todays post.
They are offering a settlement figure of £400.00.
I am not being greedy, but has anyone had this happen to them? and has anyone any suggestions, do i accept or do i go for the whole amount?

This is my first credit card claim, so I would like a bit of advice if you would be so kind please?
I've already got the ball rolling with a Halifax Bank claim of £1640, but as credit cards are slightly different, with the £12 'legit charges' etc, I just need a bit of help...
I've received a list of charges up to 09/05/06!? To be honest, I don't even know if they've closed my account or not. I moved house last March and I forgot to change the address with them, so I've not been getting statements. I never had a mobile when I was with them, so I never got any phone calls from them, and basically they slipped into a black-hole. I only remembered I had a card with them in February this year when I found it in an old wallet, and being too scared to find out how much debt i was in with them, I never called them. So now, I've decided to face them and sort this mess out finally.
With the charges only going up to May 06, I'm guessing it's likely that the account's been passed to debt collectors. Would you agree?
Anyway, they now have my new address and my balance as of May 06 was £464.46. My charges total £780.00. Is it the same as the banks where I send the 2nd letter claiming these charges + interest?
Also, I'm pretty sure they'll reply saying they'll refund the difference between £20 and the 'new £12 charge'. If this is the case, would it be advisable to file MCOL? My ultimate goal is obviously to get my account balance to £0.00 and get rid of them all together. If they pay me back £8 per £20 charge, I'll get £312, which will leave me with about £150 left to clear my account to £0.00.
I'm still waiting to hear from another 3 credit card companies and another bank - hopefully I'll be debt free before the end of the year's out.
Anyone who can help me set the ball in motion would be highly appreciated!!

Go for the whole amount! They are going to pay up, they did in our case and countless others! You just need a little perseverance, they don't want to go to court so file a court claim.Reclaimed thanks to this site:

Hi there, i have recieved a partial refund from Capital One £88 against £366
i sent them another letter (2nd one) accepting the £88 as a partial payment
and asking for the rest or i will take the matter to court (using the template)
they sent me a letter as following
Thank you for writing back to me about my refund offer of £88 of the fees
we've added. I'm sorry to hear that you feel that my offer is unacceptable.
As I've already explained, we are confident our fees are both fair and legal
and I'm dissapointed to hear you're considering court action. The OFT
haven't told us that we're obliged to refund any fees, and we've offered
refunds as a gesture of goodwill. I'm afraid I'm not prepared to refund all the
fees we've added as you've requested.
While you're disputing these fees, it is important that you maintain
payments as your account balance consists of transactions you have
made. Failure to do this may result in negative information being recorded
on your credit file, which may affect your ability to gain credit in the future.
Financial regulations require me to advise you that a refund of £88 is my
final response in relation to this matter. However, you now have the option
to contact the Financial Ombudsman Service within six months from the
date of this letter. Their contact details are in our complaints leaflet, which i
included in my last letter.
Again, I'm sorry i can't refund all of your fees and i hope we can move on from here

can somebody who has been at this stage please advise if this is a standard letter they send out, i want to proceed with the MCOL but would like to
make sure this is the standard letter and not some fine tuned custom letter.
From what they've written it sounds like im heading to a dead end :rolleyes:
