Cap One finally sent me the letter id been waiting for and have agreed to pay the lot!!
Yippeee.....
Now what do i do about MCOL? Wait for 14 days to ensure my money is here but once it is how do i stop the claim?

Have they said in their letter that they will defend the claim on the basis that they have paid you? They did that in our case.
If the bank is just biding time before they send you a cheque (and have told you so in a letter already), you might be sent a “Notice of Defence that Amount Claimed Has Been Paid”. You have to tick the box whether you wish to proceed with the claim or not. Wait until you have the money in your account, then send the form back. You are given a month to do so.
If they don't defend you just wait till the money is there and then ring the court.Reclaimed thanks to this site:

Capital One are causing me a misery, can anyone please advise how i stop the incessant phone calls from them and ensure that they pay me back the £1800 in charges that they have applied on a card totalling £200.
They seem to ignore letters and certainly cannot comprehend the meaning of customer service.
Any suggestions with dealing with this nightmare of a company would be most welcome.

This is strange, I got a letter through from capital one saying
"it is denied that these fees are unlawful"...
"Whilst we do not accept liability for the claim, I have in an effort to resolve this matter wthout the need for a court hearing refunded XXXXX to you r account"
"The refind has left you XXX in credit and i've arranged to send you a cheque for this amount"
"I would finally request that you contact the court to confirm the settlement and dis continue your claim"
I did not do thisbecause i wanted to actually have the cheque first
and finally
"we have also written to the court to confirm that we have paid in full"
I thought nice one and rubbed my hands together!
Now I have checked the mcol website and it saysYou are unable to take any further action online on this claim.
The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly.
Does this mean what I think it does?0 -
I don't know what you think it means but you need to wait until you have the cheque/money from Capital One and then you can contact the court and close the case.0

Would it be too darned cheeky for me to use my Capital One credit card to pay the MCOL fees? We're skint at the moment and this is the only source of money we have at the moment. Otherwise we'll have to keep on waiting, and my claim has been dragging on for ages (due to the fact that I can't afford 80 pounds in MCOL fees).0

Don't worry, we had exactly the same happen to us. They are pretty darn cheeky to do what they are doing, they have no intention of going to court and just use the Defence option to bide time. You will get a form from the court saying that Cap 1 is defending on the basis that they have paid and asking whether you want to proceed with the claim or not, you get a month to complete the form and send it back. Wait till you get the cheque from Cap 1, put it in your account and then send the form back to the court with a copy to Cap 1. Trust me, the cheque WILL come and you will NOT have to go to court at all.Reclaimed thanks to this site:

Can anyone help i requested £456.00 reclaimed charges back from capital one on 09/03/07 there 14 days is up tomorrow, however i have just checked the capital one account today and they have paid in £118.00 as a refund of charges. shall i send them a letter to say i accept this as part payment. Any advice would be great.0

Absolutely, stick to the process, send a letter saying thanks for the part payment however you will be proceeding through the courts for the full amount if not settled within 14 days. If you don't hear file MCOL and they pay up! I have just successfully claimed over 1000 when they offered me 280!!
